H. The storage of materials, installation of processes and/or equipment outdoors may <br />place the facility into the Industrial/Commercial Facility Storm water program <br />and require submittal of a Notice of Intent (NOI) to the Regional Water Quality <br />Control Board. The elimination of exposure to storm water by relocating indoors, <br />covering or utilizing other engineered controls is highly recommended. If an NOI <br />filing is required it must be submitted prior to finaling of the building permit or <br />issuance of certificate of occupancy. A copy of the NOI shall be provided to the <br />City's' Environmental Services office. <br />I. The generation or discharge of wastewaters, other than domestic sewerage, may <br />require a pretreatment permit for discharge to the sanitary sewer. If a permit is <br />required, submittal of an application to the City's Environmental Services is <br />required prior to finaling of the building permit or commencing the discharge; <br />whichever shall occur first. <br />V. ENGINEERING & TRANSPORTATION <br />A. Pursuant to Government Code Section 66020, including Section 66020 (d) (1), the <br />City HEREBY NOTIFIES the applicant for this Project that the 90-day approval <br />period (in which the applicant may protest the imposition of any fees, dedications, <br />reservations, or other exactions imposed on this Project by these Conditions of <br />Approval) will begin on the date of the conditional approval of this Project. If you <br />fail to file a protest within this 90-day period, complying with all of the <br />requirements of Government Code Section 66020, you will be legally barred from <br />later challenging any such fees, dedications, reservations or other exactions. <br />B. The proposed development shall comply with City ordinances, policies and <br />regulations. All improvements shall be in accordance with the City's Design <br />Standards, Specifications and Standard Plans unless otherwise specifically <br />approved by the City Engineer. <br />C. Applicant shall pay design review fees, development impact fees, permit fees, <br />inspection fees, and any other fees charged by the City or other reviewing agencies <br />for the review, approval, permitting and inspection of the public and/or private <br />improvements. <br />D. Applicant shall place gravel or other semi permeable base material in any unpaved <br />areas of the empty truck trailer and empty box storage areas of the rear yard of 2140 <br />Davis Street to keep dust in the area at a minimum. In the event that gravel is <br />placed as a permanent solution, a 50'-long x 40'-wide minimum entrance to the <br />unpaved area must be maintained in a condition that will prevent tracking and <br />flowing of sediment onto public rights-of--way (See City of San Leandro Standard <br />Detail 606). All vehicles shall pass over the entrance prior to leaving the unpaved <br />area. When necessary, Applicant shall ensure that tires are washed to remove <br />sediment prior to entrance into pubic rights-of--way. When washing is required, it <br />shall be done on an area stabilized with crushed stone that drains into an approved <br />sediment trap or sediment basin.
