i' <br />F. High piled storage in buildings shall comply with the Fire Code. <br />G. The project shall comply with the applicable Building and Fire Codes as adopted <br />by the City of San Leandro. <br />IV. ENVIRONMENTAL SERVICES <br />A. If the facility will store more than 55 gallons, 200 cubic feet or 500 pounds of <br />hazardous material and generate any amount of hazardous waste then: Prior to <br />issuance of a certificate of occupancy or final of a business license, whichever <br />occurs first, a Hazardous Materials Business Plan (HMBP) shall be submitted to <br />the Environmental Services Division for the storage and use of planned hazardous <br />materials and/or generation of hazardous waste. The plan is subject to the review <br />and approval of the Environmental Services Section; <br />OR <br />If the facility will store less than 55 gallons, 200 cubic feet or 500 pounds of <br />hazardous material or generate any amount of hazardous waste then: Prior to <br />issuance of a certificate of occupancy or final of a business license, whichever <br />occurs first, a Small Quantity Registration shall be submitted to the <br />Environmental Services Division for the storage and use of planned hazardous <br />materials and/or generation of hazardous waste. The registration is subject to the <br />review and approval of the Environmental Services Section. <br />B. All fees and charges related to Environmental Services programs shall be paid <br />promptly in full. Failure to keep accounts current shall be grounds for revocation <br />of the conditional use permit. <br />C. Compressed gas cylinders and tanks shall be secured to prevent falling due to <br />contact, vibration or seismic activity. See 2007 California Fire Code §3005.5.3 <br />for acceptable securing methods. Cylinders can also be stored outside in secure <br />gated and locked enclosures with the exempt amounts listed in the 2007 <br />California Fire Code Table 2703.1.1(3). <br />D. Flammable gases quantities and oxidizing gases quantities shall comply with <br />exempt amounts per control area as per 2007 California Fire Code Table <br />2703.1.1(1-2). <br />E. All hazardous waste generated on site shall be handled and disposed of pursuant <br />to applicable local, state and federal law. <br />F. Discharge of anything to the storm water collection system, including street curb <br />and gutter, is strictly prohibited. <br />G. The elimination of exposure of materials, processes or equipment to the maximum <br />extent practicable is necessary to prevent contamination of rainwater. Exposures <br />that cannot be eliminated may require the use of Best Management Practices <br />(BMPs), both engineered and policy/procedural, to prevent remaining exposures <br />from impacting rainwater, creating illicit discharges or contaminating receiving <br />surface waters. <br />Agreement to Conditions <br />PLN2009-00016 <br />November 3, 2009 <br />Page 5 of 10 <br />
