WHEREAS, the City Council has conducted a public hearing and reviewed and <br />considered the Negative Declaration, and has determined that it has been completed by <br />the Department of Community Development of the City of San Leandro in compliance <br />with the requirements of the California Environmental Quality Act; and <br />WHEREAS, the office of the Department of Community Development of the City <br />of San Leandro is located at 835 E. 14th Street, San Leandro, California, and said <br />Department is the custodian of the documents or other materials forming the basis for this <br />determination. <br />NOW, THEREFORE, the City Council of the City of San Leandro approves the <br />attached Negative Declaration, and finds and resolves as follows: <br />1. The Negative Declaration reflects the City's independent judgment and <br />analysis on the potential environmental effects of the proposed amendments to Zoning <br />Code Article 19 Landscape Requirements and was presented to the City Council prior to <br />their consideration of said amendments. <br />2. On the basis of the whole record before the Council, including the initial <br />study, there is no substantial evidence that the proposed amendments to Zoning Code <br />Article 19 Landscape Requirements will have a significant effect on the environment. <br />Introduced by Councilmember Prola on this 19th day of January, 2010, and <br />passed and adopted by the following called vote: <br />Members of the Council: <br />AYES: Councilmembers Gregory, Prola, Reed, Souza, Starosciak, Stephens; <br />Mayor Santos (7) <br />NOES: None (0) <br />ABSENT: None <br />ATTEST: <br />Marian Handa, City Clerk <br />(0) <br />RESOLUTION N0.2010-003 2 <br />
