CITY ENGINEER'S REPORT <br />FOR <br />FINAL MAP OF TRACT 8010 <br />FINDINGS <br />Pursuant to the provisions of Section 7-1-315 of the San Leandro Municipal Code, I have <br />examined the Final Map for Tract 8010 and find that it is in substantial conformance with the <br />approved Vesting Tentative Map, and that the subdivider has either satisfied or provided security <br />for the improvements and requirements of those Conditions of Approval that are applicable to <br />this phase of Vesting Tentative Map Tract 8010 in compliance with Title VII, Chapter 1 of the <br />San Leandro Municipal Code and the State Subdivision Map Act. <br />Several of the conditions of approval listed below have noted as deferred indicating that they will <br />be required when the second tract map is filed over this vesting tentative map. <br />CONDITIONS OF APPROVAL <br />VESTING TENTATIVE MAP 8010 (ENGINEERING DEPARTMENT): <br />1. Pursuant to Government Code Section 66020, including Section 66020 (d) (1), the City <br />HEREBY NOTIFIES the applicant for this Project that the 90-day approval period (in <br />which the applicant may protest the imposition of any fees, dedications, reservations, or <br />other exactions imposed on this Project by these Conditions of Approval) will begin on the <br />date of the conditional approval of this Project. If the applicant fails to file a protest within <br />this 90-day period, complying with all of the requirements of Government Code Section <br />66020, the applicant will be legally barred from later challenging any such fees, <br />dedications, reservations or other exactions. <br />2. Applicant shall submit, obtain approval, record, and pay review fees for a tract map to <br />configure the property lines and easements as shown on the vesting tentative map and <br />noted herein prior to issuance of building permits. <br />3. Applicant shall purchase the land shown as shaded in detail B of sheet C6 (a portion of <br />APN 075-0047-008-01) from the City of San Leandro for fair market value prior to <br />recording the final map. Applicant shall provide a legal description, plat, and appraisal of <br />the land. Applicant shall pay for staff time required to process the sale. <br />4. Applicant shall request a vacation of the portion of Martinez Street shown as shaded in <br />Detail A of sheet C6 by submitting a written request, legal description, and plat. Applicant <br />shall pay for staff time required to process the vacation. DEFERRED <br />5. Applicant shall expand the easement shown on sheet C3 for the pedestrian paseo over lot 1 <br />so that the entire paseo shown on sheet L2-1 is contained within the easement. <br />Page 1 of 6 <br />
