(g) The contractor shall be required to comply with the City's noise control <br />ordinance. <br />(h) Insofar as possible, noisy operations shall be performed off-site or on <br />portions of the site distant from residential neighborhoods. <br />(i) All construction contracts shall include the following requirements: (1) <br />unpaved construction sites shall be sprinkled with water at least twice per day if dust is <br />present, (2) trucks hauling construction materials shall be covered with tarpaulins or <br />other effective covers, (3) streets surrounding demolition and construction sites shall be <br />swept at least once per day during periods of active construction, and (4) paving and <br />planting shall be done as soon as possible. City shall charge Owner, and Owner shall <br />pay, for all costs of sweeping City streets in the vicinity of the project as necessary to <br />control dust and spillage. <br />(j) All construction contracts shall include requirements that construction <br />equipment will avoid unnecessary idling to reduce CO, ROG and NOx emissions. <br />(k) If archaeological or historical resources are discovered during <br />excavation/grading, work shall be suspended and a qualified archaeologist or historian <br />shall be hired at Owner's expense to examine the findings and recommend appropriate <br />mitigation. Such mitigation shall be reviewed and approved pursuant to the CEQA <br />Guidelines. <br />(I) All fill material imported to the project site shall be tested for toxicity. <br />Owner shall submit the results of such testing to the City. Fill material which has toxicity <br />levels in excess of permissible local, state or federal levels shall not be used on the <br />project site. <br />(m) All metal fences and ancillary structures in the right-of-way and in close <br />proximity to the transmission lines shall be grounded, in accordance with applicable <br />specifications, to eliminate potential electric shocks. Appropriate cautionary signing <br />shall also be installed. <br />(n) Owner's responsibility for the treatment, management, or disposal of <br />hazardous substances, hazardous wastes or hazardous materials (collectively, <br />"Hazardous Substances") shall be no greater than nor less than that provided pursuant <br />to applicable federal, state and/or local law and regulations. Notwithstanding the <br />foregoing, Owner shall be solely responsible for the disposal of soil and other materials <br />extracted from roadway excavation during construction of the Improvements, whether or <br />not such soil and excavated materials contain Hazardous Substances. Owner shall be <br />responsible for any additional conditions imposed by any other regulatory agency to the <br />extent such conditions are necessary for the removal of the excavated soils and or the <br />replacement of the removed soil. <br />SIGNATURES ON FOLLOW/NG PAGE(S) <br />1328680-7 17 <br />
