(g) The contractor shall be required to comply with the City's noise control ordinance. (h) Insofar as possible, noisy operations shall be performed off-site or on portions of the site distant from residential neighborhoods. (i) All construction contracts shall include the following requirements: (1) unpaved construction sites shall be sprinkled with water at least twice per day if dust is present, (2) trucks hauling construction materials shall be covered with tarpaulins or other effective covers, (3) streets surrounding demolition and construction sites shall be swept at least once per day during periods of active construction, and (4) paving and planting shall be done as soon as possible. City shall charge Owner, and Owner shall pay, for all costs of sweeping City streets in the vicinity of the project as necessary to control dust and spillage. (j) All construction contracts shall include requirements that construction equipment will avoid unnecessary idling to reduce CO, ROG and NOx emissions. (k) If archaeological or historical resources are discovered during excavation/grading, work shall be suspended and a qualified archaeologist or historian shall be hired at Owner's expense to examine the findings and recommend appropriate mitigation. Such mitigation shall be reviewed and approved pursuant to the CEQA Guidelines. (I) All fill material imported to the project site shall be tested for toxicity. Owner shall submit the results of such testing to the City. Fill material which has toxicity levels in excess of permissible local, state or federal levels shall not be used on the project site. (m) All metal fences and ancillary structures in the right-of-way and in close proximity to the transmission lines shall be grounded, in accordance with applicable specifications, to eliminate potential electric shocks. Appropriate cautionary signing shall also be installed. (n) Owner's responsibility for the treatment, management, or disposal of hazardous substances, hazardous wastes or hazardous materials (collectively, "Hazardous Substances") shall be no greater than nor less than that provided pursuant to applicable federal, state and/or local law and regulations. Notwithstanding the foregoing, Owner shall be solely responsible for the disposal of soil and other materials extracted from roadway excavation during construction of the Improvements, whether or not such soil and excavated materials contain Hazardous Substances. Owner shall be responsible for any additional conditions imposed by any other regulatory agency to the extent such conditions are necessary for the removal of the excavated soils and or the replacement of the removed soil.
