the Lot 1 improvements, and upon completion of the .Improvements required for Lot 2 <br />and final acceptance by City of said Improvements, City shall refund to Owner (or to such <br />other party that has provided such deposit), the unused portion (if any) of the deposit <br />made pursuant to this paragraph for inspection of the Lot 2 Improvements. <br />Upon completion, Owner shall furnish City with a complete and reproducible set <br />of final as-built plans and AutoCAD copies of the construction documents for the <br />Improvements, including any City-authorized modifications, and upon delivery of such <br />plans and documents, City shall examine the Improvements without delay. If the <br />Improvements are found to be in accordance with the Plans and this Agreement, City <br />shall recommend acceptance of the work to the City Council, and upon acceptance, <br />shall notify Owner or its designated agents thereof. <br />No inspection, approval or use of the Improvements, or statement by any officer, <br />agent, or employee of the City indicating. City's acceptance of any part or stage of the <br />Improvements shall be final until City delivers written notice of acceptance of all of the <br />Improvements, which notice shall be delivered as soon as practicable following City's <br />acceptance. <br />Title to, and ownership of all of the Public Improvements shall vest absolutely in <br />City upon completion and City's acceptance of such Public Improvements unless <br />expressly provided otherwise in this Agreement. <br />5. Estimated Cost of Improvements; Security and Bonds. <br />5.1 Cost Estimate. The Improvements required for Lot 1 (as shown on the <br />Map) (the "Lot 1 Improvements") are those shown on the Plans along West Estudillo <br />Avenue, along Martinez Avenue from West Estudillo Avenue to the southern edge of Lot <br />1, and along the southern edge of Lot 1 (the "pedestrian paseo"), together with any work <br />required by the City Engineer to transition and connect constructed Improvements to <br />adjacent improvements, but excluding the work shown on the Plans entitled "Sanitary <br />Sewer Realignment Plan." As of the Effective Date, the estimated construction cost for <br />the Lot 1 Improvements is Two Million, Forty-Two Thousand, Four Hundred and <br />Nineteen Dollars ($2,042,419). <br />The Improvements required for Lot 2 (as shown on the Map) (the "Lot 2 <br />Improvements") are those shown on the Plans along Martinez Avenue from the <br />northern edge of Lot 2 to the southern edge of Lot 2 and along the northern edge of Lot <br />2 (the "pedestrian paseo") and including the work shown on the Plans entitled "Sanitary <br />Sewer Realignment Plan," together with any work required by the City Engineer to <br />transition and connect constructed Improvements to adjacent improvements. As of the <br />Effective Date, the estimated construction cost for the Lot 2 Improvements is One <br />Million, Five Hundred Ninety-Four Thousand, Six Hundred Eighty-Seven Dollars <br />($1,594,687). <br />~s2ssaoa 4 <br />
