At the April 5 meeting, six members of the <br />Council were present, and the motion to approve the ordinance failed by a vote of 3-3 (Members <br />Souza, Starosciak and Stephens opposed). <br />On Apri16, 2010, Mayor Santos filed a Notice of Suspension with the City Clerk, by authority of <br />Section 305(h) of the City Charter. The suspension constitutes a motion for reconsideration of <br />the action, to be voted upon at this meeting. <br />Article VI, Section 610 of the Charter of the City of San Leandro states that the City Council, by <br />ordinance, may provide for the method of conducting municipal elections. The proposed <br />ordinance provides for the use of RCV for the 2010 General Municipal Election. <br />Section 9 of the MOU allows the City to withdraw its participation with 120 days notice, <br />provided the City pays its proportionate share of the costs related to RCV that have been incurred <br />by the County as of the date of withdrawal. These costs are roughly estimated at approximately <br />$90,000, of which $42,000 is the City's share of the RCV system cost. <br />If the Council adopts the proposed ordinance, the City's General Municipal Election will be held <br />on November 2, 2010 using the RCV method, and no runoff election would be required. The <br />cost of conducting the RCV election is estimated to be $187,000. <br />If the Council does not adopt the ordinance, and chooses to withdraw the City's participation in <br />the RCV MOU, the City will be required to pay the contractual costs (estimated at $90,000), the <br />cost of conducting the November General Municipal Election (estimated at $50,000), and the <br />cost of a possible runoff election (estimated at $200,000 for a standalone all-mail ballot election). <br />The total cost under this scenario is estimated at $340,000. <br />Current City Council Policy <br />City Charter Section 225(b) requires a successful candidate to receive at least fifty percent (50%) <br />plus one of the votes cast for an office. <br />Previous City Council Action(s) <br />January 19, 2010-The City Council adopted Resolution No. 2010-006, approving the <br />Memorandum of Understanding between the County of Alameda and the Cities of Oakland, <br />Berkeley and San Leandro, to reimburse the County for costs it will incur in the conduct of the <br />RCV election. <br />February 1, 2010-The City Council passed to print and adopted Ordinance No. 2010-002, <br />amending Article 1, Chapter 1-11 of the San Leandro Municipal Code to change the date of the <br />City's General Municipal Election from June to November of even-numbered years. This change <br />allows the City to conduct the RCV election in November 2010, along with the Cities of <br />Berkeley and Oakland. <br />March 15, 2010-The City Council voted to continue consideration of the ordinance providing <br />for the conduct of the November 2010 election by RCV to its April 5, 2010 meeting. <br />
