April 15, 2010 - Final <br />Section 6.11. Timingof Project Construction and Completion. <br />(a) Project Phasing. The Project is expected to be built over several phases in <br />response to existing market conditions, changes in health care delivery <br />requirements, member needs, market orientation and demand, interest rates, <br />competition and other similar factors over the Term of the Agreement. <br />(i) Kaiser Medical Center Project Site. <br />a. Phase 1. Initial site work would include the construction of <br />additional entrances to the site with associated street and signal <br />improvements, modifications to the current site improvements, <br />major excavation and grading for the hospital site, and completion <br />of the site improvements. Phase 1 shall consist of an <br />approximately 436,000 square foot, six -story 264 bed hospital, a <br />275,000 square foot, six -story Hospital Support Building, a <br />31,000 square foot central utility plant, a 20,000 square foot <br />outdoor service yard, and parking necessary to meet the parking <br />demand at any particular phase of construction. Total parking for <br />Phase 1 would include up to 2,100 stalls on a surface parking lot. <br />Phase 1 is anticipated to be open between 2013 and 2015. <br />b. Buildout. Buildout may include the potential expansion of the <br />hospital and/or the construction of new medical offices or other <br />uses after the initial complement of construction is completed and <br />through January 1, 2030. Buildout could include expansion of the <br />Kaiser Medical Center by an additional 375,000 square feet, <br />including a 175,000 square foot, 120 bed expansion of the <br />hospital, the construction of two 100,000 square foot Medical <br />Office Buildings, and the construction of structured parking <br />depending on Developer's facility requirements for the delivery of <br />health care to its members and the community. <br />(ii) Mixed -Use Retail Development Project Site. <br />a. The Mixed -Use Retail Development may consist of 387,000 <br />square feet of retail uses. <br />b. The Mixed -Use Retail Development could also include a <br />residential project consisting of up to 250 one- and two-bedroom <br />apartments or a hotel of up to 210 rooms. <br />C. If the Mixed -Use Retail Development does not include a <br />residential or hotel component, the total square footage of the <br />retail component could be up to 432,000 square feet. <br />(b) Notwithstanding any provision of this Agreement or Title 5, Chapter 4 of the <br />City Administrative Code, City and Developer expressly agree that there is <br />1410321.1 20 <br />
