IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2010-044 <br />RESOLUTION OF THE CITY COUNCIL AMENDING THE GENERAL PLAN <br />LAND USE DESIGNATION PURSUANT TO PLN2009-00030 <br />FOR THE KAISER PERMANENTE SAN LEANDRO MEDICAL CENTER <br />AND MIXED-USE DEVELOPMENT PROJECT <br />WHEREAS, the approximately 63 -acre site, located generally between I-880 and <br />Merced Street, and between Marina Boulevard and Fairway Drive, is currently designated with <br />land use designations of General Industrial and Light Industrial on the General Plan Land Use <br />Diagram of the San Leandro General Plan; and <br />WHEREAS, the intent of the General Commercial land use designation is to provide for <br />larger shopping centers, shopping districts, and commercial uses all providing a broader range of <br />goods and services and serving a broader market than the neighborhood commercial areas; and <br />WHEREAS, the proposed General Plan amendment is consistent with the overall goals, <br />objectives, and policies of the General Plan; that the proposed General Plan amendment will not <br />cause the General Plan to become internally inconsistent; and that the General Commercial land <br />use designation would allow residential mixed-use retail uses and/or hospital uses as proposed by <br />the Project; and <br />WHEREAS, in accordance with the California Environmental Quality Act ("CEQA"), <br />the City issued a Notice of Preparation ("NOP"), indicating an intent to prepare an <br />Environmental Impact Report ("EIR") on the Project; and <br />WHEREAS, a Draft EIR on the Project, SCH #2008012056, was prepared and released <br />by the City and circulated for public review and comment from January 25, 2010 to March 10, <br />2010; and <br />WHEREAS, the Planning Commission held a duly noticed public hearing on the Draft <br />EIR on February 18, 2010; and <br />WHEREAS, the Final EIR ("FEIR") was published on April 12, 2010, which contained <br />written responses to all comments received on the Draft EIR; and <br />WHEREAS, the Planning Commission conducted a duly noticed public hearing on the <br />FEIR and the Project on April 22, 2010, where all interested parties were given the opportunity <br />to participate in the public hearing by submittal of oral and written comments. <br />WHEREAS, the City Council conducted a duly noticed public hearing on the FEIR and <br />the Project on May 3, 2010, where all interested parties were given the opportunity to participate <br />in the public hearing by submittal of oral and written comments. <br />
