EIR and in the record, as well as other relevant information in the record of the <br />proceedings for the Project. <br />IX. SIGNIFICANT BUT MITIGATABLE IMPACTS <br />26. Under Public Resources Code section 21081(a)(1) and CEQA Guidelines sections <br />15091(a)(1) and 15092(b), and to the extent reflected in the EIR and the MMRP, the City <br />Council finds that changes or alterations have been required in, or incorporated into, the <br />components of the Project that mitigate or avoid potentially significant effects on the <br />environment. The following potentially significant impacts will be reduced to a less than <br />significant level through the implementation of Project mitigation measures: <br />a. Visual Quality: Impact VQ -2 finds that the proposed project (including both Phase <br />1 and Build -Out of the Kaiser Medical Center and the Mixed -Use Retail <br />Development) could create a new source of substantial light or glare that would <br />adversely affect day or nighttime views at the project site and vicinity. This impact <br />will be mitigated through the implementation of Mitigation Measure VQ -2.1, which <br />requires the project sponsor(s) to apply street lighting standards and other exterior <br />lighting standards that are designed to reduce glare on adjacent properties. <br />b. Air Quality: Impact AQ -4 finds that the potential residential uses of the Mixed Use <br />Retail Development component of the proposed project could expose on-site <br />sensitive receptors to substantial concentrations of toxic air contaminants. There <br />would be potentially significant impacts for the Mixed -Use Retail Development if <br />residential uses were proposed within 500 feet of 1-880. If residential uses are <br />proposed outside of the 500 -foot buffer zone from 1-880, then no mitigation would <br />be required. If residential uses are proposed within 500 feet of 1-880, the impact will <br />be mitigated through the implementation of Mitigation Measure AQ -4.1, which <br />requires preparation of a health risk assessment and, if necessary to meet BAAQMD <br />standards, incorporation into the project design of recommendations for reducing <br />exposure to on-site residents. <br />c. Hazardous Materials: <br />(1) Impact HAZ-1 finds that development of the proposed project would occur on <br />property that is known to contain contaminated soil; therefore the proposed <br />project could expose construction workers to existing or previously <br />unidentified contaminants. This impact will be mitigated through the <br />implementation of Mitigation Measure HAZ-1.1, which requires the project <br />applicant(s) to coordinate with the City and regulatory agencies and follow any <br />necessary plans to ensure that construction workers are protected from <br />unacceptable exposure to residual levels of hazardous substances during site <br />development. <br />(2) Impact HAZ-2 finds that operation and occupation of the proposed project <br />could expose people to existing or previously unidentified contaminants.
