adversely affected when traffic associated with development of Phase 1 of the <br />Kaiser Medical Center together with the Mixed -Use Retail development is <br />added. Mitigation Measure TR -1.3 requires a new signalized driveway into the <br />northern portion of the Mixed -Use Retail Development project site along <br />Marina Boulevard between the I-880 southbound ramps and Merced Street. <br />This new signalized driveway would permit both left and right turns in from <br />westbound and eastbound Marina Boulevard, providing a new access point to <br />the project site and thus diverting a portion of traffic away from the Marina <br />Boulevard/Merced Street intersection. Vehicles exiting the project site from <br />this new driveway onto Marina Boulevard would be restricted to right turns <br />only. In order to prevent additional on-site impacts to the Mixed -Use Retail <br />Development associated with the new driveway and entrance roadway, a 60 - <br />foot wide driveway and roadway width with parking restrictions on either side <br />would be required. The mitigation measure requires the project sponsors to <br />contribute fair -share funds towards this improvement. However, the left -turn <br />lane required for the new signalized driveway along Marina Boulevard would <br />encroach into Caltrans right-of-way and would require approval of an <br />encroachment permit by Caltrans. As such, approval of this mitigation is <br />exclusively within the responsibility and jurisdiction of Caltrans and the City, <br />as lead agency for the Project, cannot guarantee Caltrans' approval. While the <br />City is requiring as a condition of approval that Kaiser seek an encroachment <br />permit from Caltrans, because the City cannot guarantee that this mitigation <br />measure will be fully implemented and there is no other feasible mitigation, <br />impacts to the Marina Boulevard / Merced Street intersection are considered <br />significant and unavoidable for purposes of the CEQA analysis. This <br />potentially unavoidable significant impact is overridden as set forth below in <br />the Statement of Overriding Considerations. <br />d. Traffic Impacts - Cumulative (2030) plus Phase 1 plus Mixed Use Retail <br />Development. When added to projected cumulative traffic levels by year 2030, <br />traffic associated with development of Phase 1 of the Kaiser Medical Center <br />together with traffic from the mixed-use retail development would cause several <br />intersections to degrade to substandard levels of service. Implementation of <br />Mitigation Measures TRI. I to TRI A (all described above) if feasible, would reduce <br />the impacts under Cumulative plus Phase 1 plus Mixed -Use Retail Development <br />conditions except at the following intersections. <br />(1) Impact TR -9 finds that the Davis Street/Doolittle Drive intersection would <br />operate at substandard levels with and without the addition of project traffic, <br />but that project traffic would significantly cause the volume/capacity ratio <br />(V/C) to increase. Therefore, the project impact is significant. Mitigation <br />Measure TR -9.1 requires the westbound lanes to be re -striped to provide one <br />left turn lane, one through lane, and two right -turn lanes. The mitigation <br />measure requires the project sponsors to contribute fair -share funds towards <br />this improvement. However, implementation of this mitigation measure would <br />require an encroachment permit from Caltrans. As such, approval of this <br />mitigation is exclusively within the responsibility and jurisdiction of Caltrans <br />-12- <br />
