immediately adjacent to and connected to the hospital; a central utility plant and <br />up to 2,100 parking spaces in a surface parking lot. The site is an approximately <br />38 acre, southern portion of a 63 acres property located between I-880 and <br />Merced Street, and between Marina Boulevard and Fairway Drive; consisting of <br />11 separate Alameda County Assessor's Parcel Numbers between 077A-0647- <br />001-34 and 077A-0647-012-03. <br />B. No application for amendment of the application or Conditions of Approval may <br />be submitted or accepted for processing by the city unless (i) there is full <br />compliance with all terms of the application and Conditions of Approval; or (ii) <br />the Community Development Director can waive compliance with the terms of the <br />application if they are minor in content <br />C. Construction of the project shall remain in substantial compliance with the <br />approved exhibits and plans. Any change to the project design, materials or colors <br />shall be subject to the review and approval of the Community Development <br />Director who may administratively approve minor changes, or for more <br />substantial changes, require review by the Planning Commission and City <br />Council as a modification to the Planned Development. <br />III. ADDITIONAL SUBMITTAL REQUIREMENTS <br />A. Prior to approval of a certificate of occupancy for the hospital and/or Hospital <br />Support Building in Phase 1 of the Medical Center, the Applicant shall be <br />required to submit detailed calculations demonstrating the fair -share obligations <br />of the project toward development and implementation of an adaptive traffic <br />signal system that would include all the signals along the Marina Boulevard <br />corridor between Merced Street and Alvarado Street, and along the Merced Street <br />corridor between Marina Boulevard and Fairway Drive, pursuant to the EIR <br />Mitigation Measure TR- 1.1. <br />B. Upon submittal of a future development application for the Mixed -Use Retail <br />Development, such application shall be required to undergo Subsequent or <br />Supplemental environmental review pursuant to CEQA. <br />1. The subsequent environmental review shall ensure that all mitigation <br />measures applicable to the Mixed -Use Retail Development from the EIR <br />prepared for this approval are carried forward for that future project. <br />2. The subsequent environmental review shall also be required to include <br />detailed calculations demonstrating the fair -share obligations of that <br />project toward development and implementation of all required <br />transportation mitigation measures from the EIR prepared for this <br />approval, as well as any additional measures that may be further required <br />pursuant to that subsequent review. <br />PLN2009-00030 Page 4 of 14 <br />Recommended Conditions of Approval April 22, 2010 <br />
