LAVWMA — Sanitary Sewer Easement 2 May 17, 2010
The City of San Leandro owns property on the Bay Trail known by APN 080G-0910-002-14,
APN 080G-1406-031, APN 080G-1409-138, and APN 080G-0910-002-24. These parcels
neighbor the Heron Bay development and are used as part of the bay trail. LAVWMA proposes
to place the new pipeline on these parcels adjacent to its existing pipeline. This segment, known
as the Western Terminus, will connect to EBDA's pipeline at Roberts Landing at the San
Leandro Marina and is the final link of the 16 -mile LAVWMA Export Facilities Pipeline
Replacement project.
Analysis
This project will replace the original pipeline with a new 36" diameter high density polyethylene
pipe (HDPE). The pipeline will be installed using directional drilling. Impacts will be minimal
and any disturbed sites will be restored upon completion of construction. LAVWMA requested
two permanent easements and temporary permit to enter and use property at three locations
along the bay trail at the aforementioned APNs for the sanitary sewer pipeline. The use of these
properties shall be strictly limited to the construction and maintenance of the pipeline.
Fiscal Impact
All costs for the construction and maintenance of the sanitary sewer pipeline on the
aforementioned APNs are the responsibility of LAVWMA under the provisions of the grant of
easement agreement and the temporary permit to enter and use property agreement. LAVWMA
has agreed to pay $7,500 for each of the two permanent easements, for a total of $15,000.
AttnrhmPnte
• Temporary Permit to Enter and Use Property agreement, including conditions and legal
descriptions
• Draft Grant of Easement Agreement for the two permanent easements and legal descriptions
CONCLUSION
Staff recommends authorizing the City Manager to execute a Grant of Easement agreement
substantially in the form attached and a Temporary Permit to Enter and Use Property agreement
with Livermore Amador Valley Water Management Agency (LAVWMA), permitting the
construction and maintenance of a sanitary sewer pipeline on City of San Leandro property.
G:\_Admin\COUNCIL\2010\5 MAY 17\LAV WMA - Grant Of Easement\LAVMWA Sanitary Sewer Easement Approval MEM.Docx
