MINUTES Page 8 <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-May 3, 2010 <br />• Ordinance No. 2010-010, an Ordinance Amending Title 2, Chapter 13, Section <br />2-13-140 of the San Leandro Municipal Code to Provide for an Adjustment to the <br />Emergency Medical Services Tax (EMS Tax) Based on the Annual Consumer <br />Price Index (CPI) Increase (increases the tax by 0.7%, from $14.65 to $14.75 per <br />benefit unit). <br />- Passed to print <br />M/S/C Prola and Stephens. Ayes: 7; Noes: 0 <br />C. Matter of Adoption of a Supplemental Traffic Impact Fee and Related Administrative <br />Regulations for the Implementation of the Fee Program for Developments Within a <br />Zone of Benefit to Cover the Cost of Improvements to the Marina Boulevard/Interstate <br />880 (I-880) Interchange. <br />This being the time and place for the Public Hearing on the above matter, City Manager <br />Hollister introduced Senior Engineer Nick Thom. Mr. Thom gave a short PowerPoint <br />presentation, reporting on the need for improvements to the I-880 Marina Boulevard <br />Interchange, and providing details on the supplemental traffic impact fee proposed to <br />fund the improvements. <br />The Hearing was then opened to the public. <br />Jeff Goldfarb, Preserve San Leandro Mobility and P.H. Holdings, addressed the <br />City Council, objecting to the change in the justification for the CEQA exemption from <br />the statutory exemption cited in the public hearing notice to a categorical exemption, <br />and stating that the hearing should be re-noticed. Mr. Goldfarb commented that he <br />believes the CEQA exemption is inappropriate, and that this improvement is necessary <br />for the Kaiser project and is therefore "project splitting." Mr. Goldfarb provided a copy <br />of a letter regarding "Kaiser Permanente San Leandro Medical Center/Mixed-Use Retail <br />Development Project." He requested that the Council continue the matter, and provide <br />an environmental review of the potential impacts of the Interchange project. <br />There being no further comments from the public, and without objection, the Public <br />Hearing was closed. <br />• Resolution No. 2010-046, Resolution Adopting a Supplemental Traffic Impact <br />Fee and Related Administrative Regulations for the Implementation of the Fee <br />Program for Developments Within a Zone of Benefit to Cover the Cost of <br />Improvements to the Marina Boulevard/Interstate 880 (I-880) Interchange (makes <br />the findings described in the Traffic Fee Report, adopts the proposed supplemental <br />impact fee, and authorizes the City Manager to adopt administrative regulations <br />for the implementation of the fee program). <br />M/S/C Prola and Starosciak.
