SAN LEANDRO ADMINISTRATIVE CODE <br />TITLE 10 HUMAN RESOURCES <br />Chapter 1 Deferred Compensation Plan <br />&10.1.135: BENEFITS. <br />(a) Time of Distribution. In the event of the termination of the employment of any member <br />by reason of: <br />(1) Death, or <br />(2) Disability (defined for this purpose as the inability of a member to engage in his <br />usual occupation by reason of a medically determinable physical or mental <br />impairment as determined by the employer on the basis of advice from a <br />physician or physicians), or <br />(3) Other. termination of employment occurring at or after age fifty (50), or <br />(4) Unforeseen emergencies. <br />Then the full benefits credited to his book account shall be distributed to him or on his <br />death to his beneficiary, payment to commence not later than sixty (60) days after such <br />termination of employment unless the employee, at the time he elects to become a <br />member of the Plan, requests a later date of commencement, which date shall be not later <br />than the age of sixty-five (65). <br />(b) Method and Amount of Distribution. Distribution to a member may be paid in case or <br />in kind, in any one or more of the following ways: <br />(1) In a lump sum. <br />(2) In annual installments over a period not to exceed ten (10) years from the date <br />distributions begin, or over a period established by the employer not greater than <br />the life expectancy of such member; life expectancies shall be determined once by <br />the employer, on the date of the initial installment distribution. No installment <br />distribution shall have a value of less than (the smaller of) $50.00 or the balance <br />credited to the member's book account. <br />Notwithstanding the foregoing to the contrary, should applicable regulations of <br />the Internal Revenue Service require a shorter period for distribution in the event <br />of the death of a member then such period shall prevail over the terms of this <br />Plan. <br />Department Responsible for Revision: Human Resources Chapter 10.1 <br />04/19/1983 Page 5 <br />
