3. Payments After Severance From Employment. <br />"Includible Compensation" includes amounts paid after the Employee's <br />Severance From Employment if paid by the later of (i) two and one-half (2-1/2) <br />months after the Employee's Severance From Employment, or (ii) the end of <br />the calendar year that includes the date of the Employee's Severance From <br />Employment subject to the following requirements: <br />a. The payment is regular compensation for services during the <br />Employee's regular working hours, or compensation for services outside <br />the Employee's regular working hours (such as overtime or shift <br />differential), commissions, bonuses, or other similar payments and the <br />payment would have been made to the Employee prior to a Severance <br />From Employment if the Employee had continued in employment with <br />the Employer. <br />b. The payment is for unused accrued vacation leave. <br />c. Notwithstanding the provisions of this Payments After Severance From <br />Employment paragraph, Includible Compensation shall include all <br />payments to an individual who does not currently perform services for <br />the Employer by reason of qualified military service (within the meaning <br />of Code section 414(u)(1)) to the extent these payments do not exceed <br />the amounts the individual would have received if the individual had <br />continued to perform services for the Employer rather than entering <br />qualified military service. <br />2.08. Deferred Compensation. <br />"Deferred Compensation" means either Elective Deferred Compensation or Nonelective <br />Deferred Compensation. <br />2.09. Designated Beneficiary. <br />"Designated Beneficiary" means the individual who is designated as the Participant's <br />Beneficiary and is the designated beneficiary under Code section 401(a)(9) and Treasury <br />regulations section 1.401(a)(9)-4. <br />2.10. Distributee. <br />"Distributee" means an Employee or former Employee who receives a distribution from the <br />Plan. "Distributee" also means the Employee's or former Employee's surviving Spouse and <br />the Employee's or former Employee's Spouse or former Spouse who is the alternate payee <br />under a qualified domestic relations order, as defined in Code section 414(p), with regard to <br />the interest of the Spouse or former Spouse. "Distributee" also means the Employee's <br />designated Beneficiary who is not the Employee's Spouse. <br />2.11. Distribution Calendar Year. <br />"Distribution Calendar Year" means a calendar year for which a minimum distribution is <br />required under Code section 401(a)(9), the Treasury regulations promulgated thereunder, and <br />the provisions of the Plan that implement these requirements. For distributions beginning <br />before the Participant's death, the first Distribution Calendar Year is the calendar year <br />immediately preceding the calendar year that contains the Participant's Required Beginning <br />Date.
