2.22. Plan. <br />"Plan" means the Code section 457(b) eligible deferred compensation plan as set forth herein <br />and any amendments hereto. <br />2.23. Required Beginnina Date. <br />"Required Beginning Date" means April 1 of the calendar year following the later of (i) the <br />calendar year in which the Participant attains age seventy and one-half (70-1/2) or (ii) the <br />calendar year in which the Participant retires. <br />2.24 Spouse. <br />"Spouse" means. the person to whom the Participant is married (or was married in the case of <br />a "surviving Spouse"). Notwithstanding the preceding provisions, a "Spouse" or "surviving <br />Spouse" shall be defined in section 7 of Title 1 of the United States Code for purposes of any <br />of the following provisions of the Plan: <br />A. The provisions of the Plan that allow rollovers by a Spouse under Code section <br />402 of the Code; <br />B. The provisions of the Plan that afford special treatment to a married participant <br />or a Spouse under the required minimum distribution rules of Code section <br />401(x)(9); <br />C. The provisions of the Plan that follow the rules contained in the Code with <br />respect to qualified domestic relations orders; and <br />D. The provisions of the Plan that allow Participants to obtain unforeseeable <br />emergency distributions for Spouse's medical or funeral expenses. <br />2.25. Severance From Employment. <br />"Severance From Employment" means the Employee ceases to be an Employee of the <br />Employer within the meaning of Code section 457(d)(1)(A)(ii). A Participant shall be deemed <br />to have severed employment with the Employer for purposes of this Plan when both parties <br />consider the employment relationship to have terminated and neither party anticipates any <br />future employment of the Participant by the Employer. <br />2.26. rust. <br />"Trust" means the deferred compensation trust, the custodial account described in Code <br />section 401(f), or the annuity contract described in Code section 401(f), created by the <br />Employer pursuant to Code section 457(g) and the Assets Held In Trust section, above, for <br />purposes of holding all amounts of compensation deferred under this Plan, all property and <br />rights purchased with such amounts, and all income attributable to such amounts, property, or <br />rights for the exclusive benefit of the Participants and their Beneficiaries. <br />2.27. Trustee. <br />"Trustee" means the trustee(s) signing the deferred compensation trust, the custodian(s) of <br />the custodial account(s) described in Code section 401(f), or the insurance company(ies) <br />providing the annuity contract(s) described in Code section 401(f), established by the <br />Employer pursuant to Code section 457(8) and the Assets Held In Trust section, above, and <br />any successors to such trustee(s), custodian(s) or insurance company(ies). <br />
