<br />prohibiting discrimination based on race, religious creed, color, national origin, ancestry, <br />physical handicap, medical condition, marital status or sex. <br />14. USE OF RECYCLED PRODUCTS. Contractors shall prepare and submit all reports, <br />written studies and other printed material on recycled paper to the extent it is available at <br />equal or less cost than virgin paper. <br />15. LIMITS OF LIABILITY. Neither the professional activities of contractor, nor the <br />presence of Contractor's employees or sub-contractors at the construction/project site(s), <br />shall relieve the General Contractor(s) of their obligations, duties and responsibilities <br />including, but not limited to, construction means, methods, sequence, techniques or <br />procedures necessary for performing, superintending and coordinating the Work in <br />accordance with the contract documents and any health or safety precautions required by <br />any regulatory agencies. The City agrees that the General Contractor(s) are solely <br />responsible for job site safety, and warrants that this intent shall be carried out in the City <br />agreement with the General Contractor(s). Given the foregoing, City shall to the fullest <br />extent permitted bylaw, waive any claim against Contractor, and indemnify, defend and <br />hold Contractor harmless from any claim or liability for injury of loss arising from <br />Contractor's alleged failure to exercise site safety responsibility. <br />City also agrees that the City, Contractor and its sub-contractors shall be indemnified by <br />the General Contractor and shall be made additional insured under the General <br />Contractor's general liability insurance policy and that a Waiver of Subrogation in favor <br />of Contractor will be provided under the General Contractor's Workers Compensation <br />policy.
