EMPLOYEE COMPUTER PURCHASE PROGRAM <br />PARTICIPATION AND LOAN AGREEMENT <br />NAME: <br />ADDRESS: <br />EMPLOYEE NO.: <br />DEPARTMENT: <br />PHONE: <br />The above named Employee/City Council Member ("PARTICIPANT") of the City of San <br />Leandro ("CITY") has been provided a copy of the City of San Leandro's Employee Computer <br />Purchase Program ("PLAN") and hereby elects to purchase a personal computer and/or certain <br />related equipment and software ("EQUIPMENT") and participate in the financing arrangement <br />offered under the Plan, and further agrees to and accepts the following terms and conditions. <br />The price, including California State sales tax, of the EQUIPMENT to be purchased is <br />($ )and is identified on the attached specification(s) (Form IS-ECPP2). <br />2. CITY agrees to provide aninterest-free loan to the PARTICIlANT in the amount of <br />($ )for not less than $500 or <br />more than $3,000, for a period not to exceed twenty-four (24) months to purchase specified <br />EQUIl'MENT. <br />3. PARTICIPANT authorizes CITY to deduct <br />($ )from each paycheck of PARTICIPANT, beginning , <br />20 ,until the amount identified in paragraph 2 above has been paid. PARTICIPANT may <br />elect to pay the remaining unpaid balance at any time prior to the last payroll deduction. <br />4. PARTICIPANT agrees not to sell, trade, or otherwise dispose of the EQUIPMENT until <br />the loan has been paid in full. PARTICIPANT also agrees that use of the EQUIPMENT <br />will be limited to PARTICIPANT'S own use and that of his/her immediate family, and any <br />reassignment or transfer of the EQUIPMENT on this Agreement will result in cancellation <br />of this Agreement. Violation of these provisions will require PARTICIPANT to <br />immediately pay to CITY the remaining unpaid balance of the loan. <br />5. Upon termination of PARTICIPANT from the employment of the CITY for any reason, the <br />remaining unpaid balance due to CITY under this Agreement shall immediately become <br />due and payable. PARTICIPANT hereby authorizes CITY to withhold from his/her final <br />paycheck, (including wages, accrued sick leave, accrued vacation payoff, and any other <br />compensation available), funds sufficient to satisfy any unpaid balance due CITY under <br />this Agreement. If the PARTICIPANT'S final paycheck is insufficient to repay the loan in <br />full, the City will issue to the PARTICII'ANT an invoice for the remaining amount, <br />payable in full within fifteen (15) working days. If CITY is unable to recover the remaining <br />balance, CITY shall be entitled to possession of the EQUII'MENT. <br />07-16-01 12 <br />
