SAN LEANDRO ADMINISTRATIVE CODE <br />TITLE 12 PUBLIC WORKS <br />Chapter 8 STREET TREE POLICY AND PROCEDURE <br />&12.8.100: GENERAL <br />A street tree is a plant of arborescent form planted within the public right-of--way. Except <br />as specifically provided in this Chapter, trees planted outside the public right-of--way are <br />the sole and exclusive responsibility of the property owner. <br />§12.8.105: STREET TREE PLANTING <br />Property owners desiring a new street tree must obtain a Street Tree Planting Permit from <br />the City, purchase the appropriate tree and plant it. Prior to issuing a Street Tree Planting <br />Permit, the City will advise the property owner of the limitations on the variety, size and <br />location of the tree. The City will also provide literature on how to plant, stake, strap, <br />feed, and water the tree, for which the property owner will be responsible. Upon <br />completion of the planting of a tree for which a Street Tree Planting Permit has been <br />issued, the City will inspect the work. If the planting is found to be satisfactory, the City <br />will assume responsibility for future maintenance of the tree (trimming, root pruning). <br />If an existing street tree is being removed by the City under the circumstances in <br />§ 12.8.110 and the property owner desires a replacement tree, the City will purchase and <br />plant the replacement tree at no cost to the property owner. <br />&12.8.110: STREET TREE REMOVAL <br />(a) CITY REMOVAL <br />The City will remove a street tree under the following circumstances: <br />(1) Where the tree is dead or damaged beyond expected recuperation <br />(by storm, vehicle accident, etc.). <br />(2) Where hazardous conditions exist (e.g., a tree in danger of falling <br />over). <br />(3) Where a tree is causing confirmed sewer problems. <br />(4) Where the City determines a tree has caused concrete damage and <br />further damage cannot be prevented by normal tree maintenance <br />measures, such as root pruning. <br />(5) Where the City is engaged in a scheduled and phased tree removal <br />and replacement program. <br />(6) Under unusual hardship circumstances upon approval by the City <br />Manager or his designated representative. <br />(b) PROPERTY OWNER REMOVAL <br />1 A street tree may also be removed, by the property owner, under the <br />following conditions: <br />(1) Where removal is required for construction of a building, <br />driveway, or other improvements in accordance with approved <br />plans. <br />09-17-01 <br />
