NOTICE OF FINDING OF NO SIGNIFICANT IMPACT <br />AND NOTICE OF ADOPTION OF MITIGATED NEGATIVE DECLARATION <br />AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS <br />Date of .Notice: <br />Name of Responsible Entity (RE): <br />Address: <br />City, State, Zip: <br />Telephone Number of RE Preparers <br />January 5, 2000 <br />City of San Leandro <br />835 East 14th Street <br />San Leandro, CA 94577 <br />(510) 577-6002 <br />These Notices shall satisfy two separate but related procedural requirements for activities to be <br />undertaken by the City of San Leandro and the Redevelopment Agency of the City of San <br />Leandro. <br />REQUEST FOR RELEASE OF FUNDS <br />On or about February 8, 2000, the City of San Leandro will submit a request to Region IX HUD <br />offices for the release of CDBG funds under Title I of the Housing and Community <br />Development Act of 1974, as amended, to undertake a project known as the ABHOW <br />Development, which consists of the site acquisition and future construction of a senior housing <br />development at the property located at 232 East 14t" Street, San Leandro. The City of San <br />Leandro Redevelopment Agency will enter into a Disposition and Development Agreement with <br />American Baptist Homes of the West (ABHOW) for the sale and development of the property <br />with 60 units of affordable senior housing. <br />RELEASE OF FUNDS <br />The City of San Leandro certifies to HUD that John Jermanis in his capacity as City Manager <br />consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce <br />responsibilities in relation to the environmental review process and that these responsibilities <br />have been satisfied. HUD's acceptance of the certification satisfies its responsibilities under <br />NEPA and allows the City of San Leandro to use Program funds. <br />OBJECTIONS TO RELEASE OF FUNDS <br />HUD will accept objections to its release of funds and the City of San Leandro's certification for <br />a period of fifteen days following the anticipated submission or its actual receipt of the request <br />(whichever is later) only if it is on one of the following bases: (a) the certification was not <br />executed by the Certifying Officer of the City of San Leandro; the City of San Leandro has <br />omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR <br />Part 58; (c) the grant recipient has incurred costs not authorized by 24 CFR Part 58 before <br />approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR <br />Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of <br />environmental quality.
