tenants, lessees, subtenants, sublessees or vendees in the property herein
<br />conveyed. The foregoing covenant shall run with the land."
<br />(b) In Leases:
<br />"The lessee herein covenants by and for the lessee and lessee's heirs, personal
<br />representatives and assigns, and all persons claiming under the lessee or through
<br />the lessee, that this lease is made subject to the condition that there shall be no
<br />discrimination against or segregation of any person or of a group of persons on
<br />account of race, color, religion, creed, sex, marital status, ancestry, or national
<br />origin in the leasing, subleasing, transferring, use, occupancy, tenure or
<br />enjoyment of the land herein leased nor shall the lessee or any person claiming
<br />under or through the lessee establish or permit any such practice or practices of
<br />discrimination or segregation with reference to the selection, location, number, use
<br />or occupancy of tenants, lessees, sublessees, subtenants, or vendees in the land
<br />herein leased."
<br />(c) In Contracts:
<br />"There shall be no discrimination against or segregation of any person or group of
<br />persons on account of race, color, religion, creed, sex, marital status, ancestry or
<br />national origin in the sale, lease, sublease, transfer, use, occupancy, tenure or
<br />enjoyment of the property nor shall the transferee or any person claiming under or
<br />through the transferee establish or permit any such practice or practices of
<br />discrimination or segregation with reference to selection, location, number, use or
<br />occupancy of tenants, lessee, subtenants, sublessees or vendees of the land."
<br />8.03 Contents of Grant Deed.
<br />Any Grant Deed from the Agency shall contain the covenants set forth in Section 8.02 of this
<br />Agreement and such conditions of approval imposed by the Agency as are required to be contained in the
<br />Grant Deed.
<br />8.04 Operating Covenants.
<br />The Developer, for itself, its successors and assigns, hereby covenants and agrees diligently to
<br />perform in accordance with the following provisions ("Operating Covenants") set forth in this Section 8.04
<br />and in Exhibit F to this Agreement
<br />(a) The terms of the Covenants shall be for 55 years from the Date of Substantial Completion.
<br />After termination of the Covenants, Developer must apply to the City of San Leandro for a conditional use
<br />permit to continue operating the Site as multi-family residential housing unless a) Developer renews the
<br />operating covenants of this Agreement or b) the San Leandro Zoning Code is amended and, at the time of
<br />termination of this Agreement, does not require new multi-family residential housing on the Site to obtain a
<br />conditional use permit
