IN THE REDEVELOPMENT AGENCY <br />OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2000 - 5 <br />RESOLUTION OF THE SAN LEANDRO REDEVELOPMENT <br />AGENCY OF THE CITY OF SAN LEANDRO APPROVING <br />SELECTION OF CREEKSIDE ASSOCIATES, LLC, AS DEVELOPER, <br />AND APPROVING THE REUSE REPORT REQUIRED BY HEALTH <br />& SAFETY CODE § 33433 FOR PROPERTY LOCATED AT 960 SAN <br />LEANDRO BOULEVARD (APN 75-36-52) AND TRANSMISSION OF <br />THE REPORT TO THE CITY COUNCIL OF THE <br />CITY OF SAN LEANDRO <br />RECITALS <br />WHEREAS, the Agency has considered the selection of, and entering into a disposition <br />and development agreement with a developer for the disposition and development of property <br />with two high-quality office buildings with an improved plaza area in accordance with <br />specifications all as more particularly described in the "Agreement," as defined below, at the <br />property located at 960 San Leandro Boulevard (the "Property"), in the Plaza 2 Redevelopment <br />Project ("Project"); <br />WHEREAS, California Redevelopment Law further provides that the Agency may select <br />and designate a developer for a designated site based upon the selected developer's plan and his <br />or her financial ability and technical ability to successfully undertake and complete the <br />development program; <br />WHEREAS, the Agency has selected Creekside Associates, LLC ("Creekside") as <br />Developer for the proposed development of the Property and the provision of certain creekside <br />improvements and maintenance of certain publicly owned property adjacent to the Property (the <br />"Adjacent City Property"), based upon the Agency's determination that Creekside has the <br />necessary expertise, skill and ability to carry out the commitments contained in the Disposition <br />and Development Agreement ("Agreement") between the Agency and Creekside, which are in <br />the best interests and will materially contribute to the Project; <br />WHEREAS, the Agreement provides for the disposition by the Agency to Creekside of <br />the Property for a purchase price of Two Million Two Hundred Sixty -Five Thousand One <br />Hundred Twenty Dollars ($2,265,120) (the "Purchase Price") and additional consideration under <br />the terms of the Agreement; <br />WHEREAS, Agency has caused to be prepared a report required by Health and Safety <br />Code § 33433 ("Reuse Report") which contains a summary of the Disposition and Development <br />Agreement ("Agreement") to be entered into between the Agency and Creekside and a summary <br />of the cost of Agreement to the Agency; <br />
