CONDITIONS OF APPROVAL <br />PLN2010-00002 - 2198 East 14th Street <br />Shamco Investment (Applicant/Property Owner) <br />I. COMPLIANCE WITH APPROVED PLAN5 <br />A. The applicant and/or property owner shall comply with Exhibits A to D, attached to the <br />application dated January 12, 2010, except as hereinafter modified. (Exhibits are on file at <br />the City of San Leandro Community Development Department, 835 East 14th Street, San <br />Leandro, California). <br />Exhibit A -Site Plan (Sheet A002) <br />Exhibit B -Fixture Plan (Sheet A102) <br />Exhibit C -Elevations (Sheet A301) <br />Exhibit D -Statement of hours/restaurant operations <br />B. The applicant and/or property owner shall be responsible for assuring that any successor in <br />interest who assumes responsibility for this approval is informed of its terms and conditions. <br />C. Construction of tenant improvements shall commence within one (1) year following <br />Community Development Director approval of the Administrative Review and shall be <br />substantially completed one year after commencement of construction. For the purpose of <br />compliance with this condition, commencement of construction shall be defined as the <br />construction of a substantial portion of the tenant improvements. <br />IL USE RESTRICTIONS <br />A. This Administrative Review approves the operation of a 3,313 square-foot full service <br />restaurant, Papa John's, at 2198 East 14th Street. <br />B. These conditions of approval shall be conspicuously posted in the restaurant building prior to <br />commencing business operations, and shall be made accessible to all employees. <br />C. The hours of the restaurant shall be restricted to 11:00 a.m. to 10:00 p.m., Monday through <br />Sunday. Any expansion or modification to the hours shall be requested in writing to the <br />Zoning Enforcement Official. <br />D. There shall be no display or sales of merchandise outside the building. Any future proposal <br />for outdoor seating would be subject to an approval of an Outdoor Facilities Permit, subject <br />to the review and approval by the Community Development Department. <br />III. PLANS SUBMITTALS <br />A. A Sign Program shall be created and submitted to the City for review and approval by the <br />Zoning Enforcement Official. Said sign program shall include a proposal for wall signs that <br />are individual letters (logo may be a cabinet) and for either the restoration of the existing <br />PeeWee's sign to be cleaned and repaired and maintained with the original "Pee Wee's" text, <br />Agreement to Conditions January 20, 2010 <br />PLN2010-00002 Page 3 of 5 <br />
