• Minutes - San Leandro City Council Meeting - January 16, 1996 Page - 9 - <br /> PUBLIC HEARINGS (continued) <br /> Terry McManus, HLA, discussed the hazardous material <br /> investigation and remediation program. He reviewed activities <br /> leading up to this summer's cleanup activities, which included <br /> abandonment of deep -water wells and relocation of soils. In <br /> response to questions, he explained deed restrictions related to <br /> capped materials and said the Department of Toxic Substance <br /> Control is responsible for enforcement. <br /> In response to questions, Mr. Hughes said the sound walls along <br /> Lewelling Boulevard are within the street right of way, and their <br /> maintenance will be the responsibility of the maintenance <br /> district and the homeowners' association for the development. He <br /> said there is an agreement with the Mission Bay Mobilehome Park <br /> to raise the existing masonry wall, and an easement is being <br /> requested from the railroad related to the Sandev wall. <br /> Calvin Platt, SWA, described the layout of the neighborhoods in <br /> the development, the number of units, entrances, elevations, <br /> architecture, the buffer area and trails, and the interpretive <br /> center. In response to questions, he said no staff was <br /> anticipated for the interpretive center; it would consist of <br /> signs. He discussed play areas and public parking. <br /> In response to questions, Mr. Hughes said the types of activities <br /> in the play areas would be dictated by the needs of the <br /> residents. He said the homeowners' association is mandatory and <br /> will be professionally managed. The streets will be private. <br /> The Hearing was then opened to the public. <br /> Dan Henriqueshe, Sunol, said the Initiative dictated 100' of <br /> buffer to protect wildlife. The proposed park in the buffer zone <br /> violates the Initiative. He requested that the City Council deny <br /> the park within the buffer zone. <br /> Janice Delfino, 18673 Reamer Road, Castro Valley, said the park <br /> in the buffer area cannot be considered as park area. She said <br /> there are manholes in the buffer area. She said the Corps of <br /> Engineers permit allowed the trail in the buffer; it also says <br /> the buffer is a refugal habitat. <br /> Kateri Harrison, 430 -1/2 Breed Avenue, said she supports the <br /> concept of the recreational areas but questions where they should <br /> be provided. She said the Initiative allows neither passive nor <br /> active recreational uses within the buffer; it allows only a <br /> wildlife habitat or a trail. She said the current proposal is <br /> for a 25' buffer only; which is a lot less than the Initiative. <br />
