She said the issue with the Maskell property is <br /> contamination and no incentive to make changes or cleanup. There are <br /> areas in San Leandro where they could exist and perhaps even do better. <br /> She said the State may come in and require cleanup. She said the area <br /> has been looked at many times, and there is no ability to make changes <br /> without eminent domain. She noted eminent domain is rarely used. The <br /> property owners in the Costco development settled with the City and <br /> received fair - market value. She said the Council is very sincere about <br /> doing everything possible to find places for people to continue to do <br /> business in San Leandro. <br /> Vice Mayor Kerr said more information is needed on the hazardous waste <br /> problems. He said the intent of eminent domain has been lost; this is <br /> not for public use. The City Attorney said the Supreme Court has <br /> determined that use of eminent domain in a redevelopment area is a <br /> public use. Redevelopment Agencies may sell property they acquire to <br /> a developer. <br /> The following Motion was then introduced: <br /> Minute Order No. 96 -9, City Council Motion Regarding the Matter of <br /> Second Amendment to Alameda County - City of San Leandro Redevelopment <br /> Plan to Provide for Power of Eminent Domain for Limited Properties in <br /> Four Development Nodes in the City of San Leandro Portion of the <br /> Project Area. (1120) <br /> On motion by Council Member Myers, who moved its approval, seconded by <br /> Council Member Galvan, with Council Member Kerr voting no (1), and <br /> Council Member Loeffler absent (1), and carried by a majority vote (5), <br /> the City Council approved the extension of eminent domain to 2398 East <br /> 14th Street (the Islander Motel); 14500 East 14th Street Avenue (the <br /> Maskell property); the Peralta Node, as described in Exhibit A, Eminent <br /> Domain Property List, excluding 800 Peralta Avenue; and 2251 and 2255 <br /> Bancroft Avenue. <br /> AlgURNWEbtWOOmENtrAtEwalhErpfk0 <br /> The Redevelopment Agency adjourned its meeting at 11:25 p.m. <br />
