Minutes - San Leandro City Council Meeting - June 17, 1996 Page - 12 -
•
•
NEW BUSINESS (continued)
Council Member Loeffler said the key issue is whether to sunset or not
sunset, and recommended voting either yes or no.
Mayor Corbett said, according to Chuck Weir of EBDA, this is the offer
as approved in January.
Council Member Galvan said it is not the same offer because LAVWMA took
out the sunset clause. What they're voting on is should there or
shouldn't there be a sunset clause.
Steve Meyers, City Attorney, said LAVWMA made a counter - offer, deleting
the sunset clause. Council Member Galvan needs to know whether to
accept or reject the counter - offer.
Mayor Corbett said Council Member Galvan should be sent forward with
the position that San Leandro does not take any position with regard to
having a sunset or not. Either way we should accept it so we can get
over that sticking point. He should be directed to vote to accept the
counter -offer by LAVWMA.
Council Member Galvan disagreed with this position but said he was
willing to support what the Council decided.
The following Motion was then introduced:
Minute Order No. 96 -20, Matter of East Bay Dischargers Authority offer
to Livermore /Amador Valley Water Management Agency regarding sewer
capacity. (1221)
On motion by Council Member Loeffler, who moved its approval, seconded
by Council Member Lothrop, with Council Members Polvorosa and Galvan
voting no (2), and carried by a majority vote (5), the City Council
directed the City's EBDA Representative to vote on behalf of the City
of San Leandro City Council to accept the LAVWMA counter offer.
D. City Council Reports on Intergovernmental Agencies. None
E. Approval of Work Session Items Requiring Action.
- Matter of Casa Peralta Priority 1 Seismic Upgrade, Americans with
Disabilities Act (ADA) Accessibility Improvements, Project No. 95-
210 -8610.
Dave Bohne, Community Services Director, referred to the Work
Session report. He said the action item was to approve the neit
step in the Casa Peralta Seismic Retrofit, which would implement ADA
improvements to the bathroom and work on the outdoor kitchen. Bob
Rockett, City Engineer, reviewed the work that has been done and the
proposed upgrades and discussed the funding.
