Minutes - City of San Leandro City Council and Page - 12 - <br /> Redevelopment Agency Meeting - November 4, 1996 <br /> Redevelopment Administrator Debbie Potter presented the Site Plan. <br /> She noted that there are two Property Owner Hearings on the Agenda - <br /> one for Council action and one for Agency action. For this meeting <br /> there will be one staff report addressing both items; the Property <br /> Owner Hearings will be conducted together. She said the Condition to <br /> build at the rear of the property was requested by the Nissan <br /> Dealership. At this time there is a 20 -foot access easement that <br /> benefits two properties located on Wayne Avenue. She said, if it is <br /> acquired, the property owners must be compensated for the loss of <br /> easement. <br /> She said appraisals have been made and property owners have received <br /> offers. In an effort to compensate the property owners for their <br /> loss in value, staff has provided for a replacement access for use as <br /> a driveway. The loss in value was determined to be a loss in <br /> parking; the compensation package includes a new driveway. <br /> She said due to the hazardous use at 2088 Wayne Avenue, the Fire <br /> Department has required a secondary access. The proposal is to <br /> acquire a portion of 2000 Wayne Avenue to create that access, as well <br /> as to create a new door. If this is done, there will be no loss in <br /> value. She said staff has met with each of the property owners and <br /> are currently in negotiations. She said staff is requesting approval <br /> of the Resolutions in order to move forward. <br /> Upon Mayor Corbett's request, Ms. Potter clarified a nonexclusive <br /> access easement as being used by the property owner, beneficiary, and <br /> emergency vehicles. She said easements are appraised at a percentage <br /> of the fee value, due to the owner remaining. She clarified that <br /> there will be no easement at 2094 Wayne Avenue; a new driveway is <br /> being created. Ms. Catalano explained that the easement is being <br /> acquired in order to extinguish it. <br /> Upon Council Member Glaze's request, Ms. Potter clarified the <br /> easement, parking, and access issues. She stated that there will be <br /> a loss of 5 -7 parking spaces on site that is included in the <br /> compensation. <br /> City Attorney Steve Meyers noted the original agreement did not <br /> require that the easements be obtained. Subsequent to that action, <br /> the Nissan Dealership now requires a building at the rear of the <br /> property. The acquisition of easements is before the Redevelopment <br /> Agency because it is a change in the manner in which the site was <br /> originally to be used. <br /> Mayor Corbett noted that the Property Owner Hearing is open. <br /> Mr Russell Salyard, owner of 2000 Wayne Avenue, and Mr. Ron Monk, <br /> came forward. Mr. Salyard said he has owned the property since 1959. <br /> He said he would like to expand his building and that the new Nissan <br /> building would be too close to his building and would not benefit his <br /> property. He said he would like to negotiate prior to the <br /> implementation of eminent domain proceedings. <br />
