M1. <br /> (a) Act or "The Act" shall mean the Federal Water Pollution Control Act, also known <br /> as the Clean Water Act, as amended, 33 U.S.C. 1251, et seq. <br /> (b) Approval Authority. Approval Authority shall mean United States Environmental <br /> Protection Agency or its authorized designee. <br /> (c) Authorized Representative of Industrial User. Authorized Representative of <br /> Industrial User shall mean one of the following: <br /> (1) A responsible corporate officer as defined in 40 CFR 40312(6)(1); <br /> (2) A general partner of a partnership or proprietorship, respectively; <br /> (3) A duly authorized representative of the individual designated above if <br /> such representative is responsible for the overall operation of the facilities from which the <br /> discharge originates. <br /> (d) Beneficial Uses. Beneficial Uses shall mean uses of the Waters of the State that <br /> may be protected against quality degradation including, but not necessarily limited to, domestic, <br /> municipal, agricultural and industrial supply, power generation, recreation, aesthetic enjoyment, <br /> navigation and the preservation and enhancement of fish, wildlife and other aquatic resources or <br /> reserves, and other uses, both tangible or intangible as specified by Federal or State law. <br /> (e) Biochemical Oxygen Demand (BOD). Biochemical Oxygen Demand (BOD) <br /> shall mean the quantity of oxygen demanded in the biochemical oxidation of organic matter <br /> under standard laboratory procedure, five (5) days at twenty (20) degrees centigrade expressed in <br /> terms of concentration of milligrams per liter (mg/L). <br /> (f) Building Sewer. Building Sewer shall mean a sewer conveying wastewater from <br /> the premises of a User to the City of San Leandro sanitary sewer system. <br /> (g) Categorical Pretreatment Standard. Categorical Pretreatment Standard shall mean <br /> any regulation containing pollutant discharge limits promulgated by EPA in accordance with § <br /> 307(b) and (c) of the Act that apply to a specific category of users and that appear in 40 CFR <br /> Chapter I, Subchapter N, Parts 405 -471. • <br /> (h) City. City shall mean the City of San Leandro. <br /> (1) City Manager. City Manager shall mean the individual appointed by the City of <br /> San Leandro governing body (City Council) with responsibility and authority for all functions of <br /> local government. <br /> (j) Commercial User. Commercial User shall mean any nonresidential user that the <br /> City determines will introduce primarily domestic sewage to the sewerage system. <br /> 2 <br />
