NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as follows: Section 1. Findings. The City Council of the City of San Leandro does hereby find as follows: A. The City Council hereby finds that for the following reasons there is a current and immediate threat to the public peace, health, safety and welfare of its citizens: (1) Current development patterns along the East 14` Street South Area present short- and Tong -term obstacles to the goal of the City to achieve a well- balanced and economically vital transit - oriented mixed -use district. (2) The proliferation of undesirable uses and improvements along the East 14 Street South Area during the time prior to the amendment of the City's General Plan, and prior to completion of a comprehensive study leading to development and adoption of a Development Strategy for development on the East 14` Street South Area, will impair or preclude the City from achieving its goal of fostering a vital transit - oriented, mixed use district. B. For the reasons set forth above and in the recitals of this Ordinance, the City Council further finds that the approval, construction, or realization of development proposals within the East 14 Street South Area that: 1) involve a change in use including, but not limited to, substitution of one permitted use with another permitted use in the applicable - zoning district; or 2) do not meet parking requirements as defined in the Zoning Code; or 3) intensify existing uses that may result in increases in noise, traffic, ,the number of employees, or other similar impacts; or 4) establish, increase, or change business hours beyond the period of 7 ant to 10 pm, would result in the threat set forth above to the public peace, health, safety and welfare of its citizens if not subject to the discretionary review procedures set forth below. C. For the reasons set forth above and in the recitals of this Ordinance, the City Council further finds that requiring discretionary approval for projects that involve changes in use, or which require site plan review, or do not provide sufficient on -site parking, or intensify existing uses, or change business hours, is necessary to protect the public health, safety, and welfare, until such time as the City may amend its General Plan, and is able to study and adopt a Development Strategy for the East 14` Street South Area. Section 2. Scope. A. All development proposals that involve a change in use, do not provide sufficient on -site parking, intensify existing uses, or that involve business hours beyond the period of 7 am to 10 pm, shall be subject to discretionary zoning review, as set forth below in Section 3. 2
