IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 99 -028 (1005/1024/1098 /1099/ <br /> 1428/2167/2792) <br /> AN INTERIM ORDINANCE PROHIBITING THE PROCESSING AND APPROVAL <br /> OF USE PERMITS, VARIANCES, BUILDING PERM OR OTHER <br /> ZONING ENTITLEMENTS FOR CHECK - CASHING BUSINESSES WHICH MAY <br /> CONFLICT \VITA PROPOSED ZONING ORDINANCES AND ZONING MAP <br /> AMENDMENTS AND DECLARING THIS ORDINANCE TO I3E AN URGENCY <br /> MEASURE, 7'O TAKE EFFECT IMMEDIATELY, AS IT RELATES TO THE <br /> PRESERVATION OF THE PUBLIC PEACE, HEALTH AND SAFETY <br /> RECITALS <br /> A. In March of 1999, the City Council began the process of adopting a new land use <br /> element for the General Plan for the City of San Leandro. <br /> 13. The City has received numerous applications for new check - cashing businesses to <br /> locate in San Leandro and the number of such businesses in the City has almost doubled in a two - <br /> year period. <br /> C. The City has received applications for traditional check - cashing businesses and new <br /> businesses offering "deferred deposit" services, which have proliferated throughout the United <br /> States. <br /> D. In light of the recent influx of applications, the City Council has decided to examine <br /> the location, frequency, and effects of such businesses and will consider whether and how to address <br /> such businesses with proposed Zoning Code amendments and in the proposed land use element of <br /> the General Plan. <br /> E. On August 2, 1999, the City Council adopted a motion prohibiting the processing and <br /> approval of use permits, variances, building permits, or other zoning entitlements for traditional <br /> check - cashing businesses and check - cashing businesses offering deferred deposit because such <br /> actions may conflict with proposed zoning ordinances and zoning map amendments. <br /> F. The City Council has directed staff to study this matter and prepare the necessary <br /> recommendations. <br /> G. On September 7, 1999, the City Council held a public hearing noticed pursuant to <br /> Government Code section 65090 and evaluated all evidence and testimony for and against the <br /> adoption of the interim ordinance; and <br /> 1 <br />
