Section 2. Additional Findings. <br /> The City Council further finds that: <br /> A. A temporary moratorium on the processing and approval of use permits, <br /> variances, building permits or other applicable entitlements for the uses identified herein is necessary <br /> to protect the public peace, health, safety, and welfare. <br /> B. A temporary moratorium will not adversely affect the orderly development <br /> of property or the preservation of property values because other uses authorized by the existing <br /> zoning ordinance and zoning maps remain available to property owners. <br /> Section 3. Scope. <br /> Check - cashing businesses are prohibited in all land use districts of the City. The <br /> Development Services Department shall not process any applications for entitlements including <br /> conditional use permits, variances, or building permits for said uses until such time as this ordinance <br /> has expired or new zoning ordinances or maps of the City have become operative, whichever is <br /> earlier. A check- cashing business is defined as a business establishment where the principal business <br /> activities include, but are not limited to check cashing for a fee, sale of money orders, and the <br /> provision of loans and cash advances, and the business is defined as a check- casher pursuant to <br /> California Civil Code section 1789.31. <br /> Section 4. Applicability. <br /> This Ordinance shall apply to all applications for check - cashing businesses that have not <br /> received final approval. Any projects already submitted for review and that have not received final <br /> action shall be denied without prejudice or returned to the applicant. <br /> Section 5. Environmental Review. <br /> The City Council finds that the adoption of this Ordinance is exempt from environmental <br /> review under the California Environmental Quality Act pursuant to Public Resources Code section <br /> 21065 based on the finding that this Ordinance is not a "project" within the meaning of Section <br /> 15378 of the State CEQA Guidelines, because it has no potential for resulting in physical change in <br /> the environment, directly or ultimately. <br /> Section 6. Effective Date. <br /> This ordinance shall take effect immediately as an urgency measure for the immediate <br /> preservation of the public peace, health, safety, and welfare. This Ordinance shall be of no further <br /> force or effect twenty -one (21) months from the date of its adoption. <br /> 3 <br />
