the laws of the State of California. Said policy shall be in the form and amount as specified by <br /> the Finance Officer. <br /> Said policy of insurance shall guarantee the payment to any and all such persons, <br /> including the City of San Leandro, suffering injury or damage to person or property of any final <br /> judgment rendered against such owner, with the limits above mentioned, irrespective of the <br /> financial condition or any acts or omissions of such owner, and shall inure to the benefit of such <br /> persons, including the City. If at any time such policy of insurance shall be cancelled by the <br /> company issuing the same, the City shall require said owner to replace such policy with another <br /> policy as above provided, satisfactory to the City and in default thereof may revoke such owner's <br /> permit and license. <br /> Section 3 -7 -135: ISSUANCE OF PERMIT. Permits issued hereunder shall be known as <br /> "Permit to Operate as an Itinerant Rubbish Hauler" and shall require an application fee as set <br /> forth in the fee resolution established by the City Council. <br /> (a) It shall not be assigned, and is not assignable. <br /> (b) It may be evoked, and all operations thereunder shall cease immediately upon <br /> receipt of written notice from the City: <br /> (1) If the holder hereof shall violate any of the laws of the State of California <br /> or the City of San Leandro; <br /> (2) If the holder hereof shall go out of business or sell out; <br /> (3) If the person named as holder herein is not the true user thereof; <br /> (4) If the manner of collection, transportation, or disposal of rubbish is <br /> unsatisfactory, as determined by the City. <br /> (c) Authorized representative of the City shall have the right to inspect all equipment <br /> and accessories of the holder of this permit at all times, whether on or off the <br /> road. <br /> (d) The permit holder shall not operate any vehicle in excess of ten (10) tons gross <br /> vehicle weight. <br /> (e) All loads carried by the permit holder shall be covered sufficiently to prevent <br /> spillage on the public right of way. <br /> Section 3 -7 -145: PERMIT REVOKED. Any person whose application for a permit has <br /> been refused, or whose permit has been revoked by the City, shall have the right, within thirty <br /> (30) days after such denial or revocation, to appeal from such action to the City Council of San <br /> Leandro, and it shall be the duty of said Council to hear such appeal and evidence upon the same <br /> and to sustain or amend the action of the City and the decision of said City Council shall be final. <br /> 10 • <br />
