(5) Such person removes rubbish or recyclable or reusable materials for <br /> charitable purposes as defined by Title IV, Chapter 22, Section 4 -22 -100, <br /> subsection (b) of this Code; or <br /> (6) Such person holds a current and valid contractor's license issued by the <br /> State of California and removes rubbish from premises upon which such <br /> person is performing work permitted under the provisions of Title VII, <br /> Chapters 1, 2 and 5 or upon which work is performed under contract with <br /> the City or any other public agency. <br /> (b) It shall be unlawful for any person not enumerated above to solicit or attempt to <br /> obtain from the owners or possessors of any property within this City permission <br /> to remove rubbish from such property. <br /> (c) It shall be unlawful to collect, dump, or deposit any rubbish upon any property <br /> located within this City belonging to another, either with or without the consent of <br /> the owner thereof; to establish or maintain a place for dumping rubbish in this <br /> City, or to collect, receive, or dump any rubbish on one's own property, save and <br /> except such rubbish as shall reasonably accumulate upon such property in the <br /> reasonable and lawful use thereof. <br /> (d) It shall be unlawful for any person to continue operation under any permit or <br /> franchise issued under the provisions of this Chapter, after having received an <br /> authorized notice, in writing, from the City that the same has been revoked. <br /> Section 3 -7 -110: ACCUMULATION OF RUBBISH. It shall be the duty of every person in <br /> charge or control of any place within the City where there is an accumulation of rubbish to <br /> remove the same. <br /> Section 3 -7 -115: COLLECTION OF RUBBISH. All rubbish shall be collected and <br /> removed by the permit holder within forty-eight (48) hours from the time the permit holder <br /> accepts such order. <br /> Section 3 -7 -120: COLLECTION OF RUBBISH BY CITY. The City of San Leandro <br /> hereby reserves the right at any time to collect, remove, and dispose of rubbish from any place in <br /> the City. <br /> Section 3 -7 -125: PERMIT. Any person desiring a permit as an itinerant rubbish hauler <br /> under the provisions of this Chapter shall apply for the same to the City of San Leandro, whose <br /> duty it shall be to determine whether or not the same should be granted under the provisions of <br /> this Chapter and to issue such permit if the applicant is entitled to the same hereunder. It shall be <br /> the duty of such applicant to give the said City all such information as may be necessary in <br /> connection with the investigation of such application, on a form prescribed by the City. <br /> Section 3 -7 -130: PERMIT — INSURANCE REOUIRED. Applicant shall also have a policy <br /> of insurance approved by the City in a solvent and responsible company, insuring the owner of <br /> such rubbish service to pay any loss by reason of injury or damage that may result to persons or <br /> property from the negligent operation of motor vehicles or from violation of this Chapter or of <br /> 9 <br />
