Section 3 -6 -135: GARBAGE DISPOSAL DEVICE PERMITTED. Nothing contained in <br /> this Chapter shall be construed to prohibit the disposal of garbage by means of a garbage <br /> disposal device permitted by Chapter 5 of Title VII of the San Leandro Municipal Code. <br /> Section 3 -6 -140: EXEMPTIONS. Any person in possession or control of property in the <br /> City of San Leandro may obtain exemption from the requirement of disposal of garbage through <br /> the regular garbage collection service of the City by establishing to the satisfaction of the City <br /> any one (1) of the following: <br /> (a) No garbage is produced or accumulated in, upon or from such property; <br /> (b) All garbage produced or accumulated in, upon or from such property is disposed <br /> of by means of a permitted garbage disposal device; <br /> (c) All garbage produced or accumulated in, upon or from such property is disposed <br /> of by agreement with, and through the use of the approved garbage container of a <br /> person subscribing to the regular garbage collection service of the City. <br /> Such exemption shall be revoked upon a determination by the City that the factual basis for such <br /> exemption no longer exists. <br /> Section 3 -6 -145: REENACTMENT. The provisions of this Chapter, insofar as they are <br /> substantially the same as existing Code provisions relating to the same subject matter, shall be <br /> construed as restatements and continuations thereof and not as new enactments. <br /> Section 3 -6 -150: COLLECTING GARBAGE AND RUBBISH FROM RESIDENTIAL <br /> AREAS. The Council may, at its sole discretion and upon such terms as it may prescribe, award <br /> a franchise or contract to any qualified person to provide garbage and rubbish collection from <br /> residential properties in the City. <br /> Section 3 -6 -155: ANTI- SCAVENGING PROVISIONS. <br /> (a) Upon the placement of recyclable materials at a designated recycling collection <br /> location for collection by an authorized recycling contractor, the recyclable <br /> materials shall become the property of the authorized recycling contractor. <br /> (b) It shall be unlawful for any person other than the authorized City employee or the <br /> City's authorized recycling contractor to take, remove or otherwise appropriate <br /> recyclable materials which have been placed for recycling collection or the <br /> container in which such recyclable materials have been placed. Any and each <br /> such removal in violation hereof shall constitute a separate and distinct violation <br /> enforceable as provided by this Code. <br /> (c) Nothing in this Article shall limit the right of an individual person, organization or <br /> other entity to donate, sell or otherwise dispose of recyclable material, provided <br /> that any such disposal is in accordance with the provisions of this Chapter. <br /> 5 <br />
