Section 3 -6 -135: GARBAGE DISPOSAL DEVICE PERMITTED. Nothing contained in this Chapter shall be construed to prohibit the disposal of garbage by means of a garbage disposal device permitted by Chapter 5 of Title VII of the San Leandro Municipal Code. Section 3 -6 -140: EXEMPTIONS. Any person in possession or control of property in the City of San Leandro may obtain exemption from the requirement of disposal of garbage through the regular garbage collection service of the City by establishing to the satisfaction of the City any one (1) of the following: (a) No garbage is produced or accumulated in, upon or from such property; (b) All garbage produced or accumulated in, upon or from such property is disposed of by means of a permitted garbage disposal device; (c) All garbage produced or accumulated in, upon or from such property is disposed of by agreement with, and through the use of the approved garbage container of a person subscribing to the regular garbage collection service of the City. Such exemption shall be revoked upon a determination by the City that the factual basis for such exemption no longer exists. Section 3 -6 -145: REENACTMENT. The provisions of this Chapter, insofar as they are substantially the same as existing Code provisions relating to the same subject matter, shall be construed as restatements and continuations thereof and not as new enactments. Section 3 -6 -150: COLLECTING GARBAGE AND RUBBISH FROM RESIDENTIAL AREAS. The Council may, at its sole discretion and upon such terms as it may prescribe, award a franchise or contract to any qualified person to provide garbage and rubbish collection from residential properties in the City. Section 3 -6 -155: ANTI- SCAVENGING PROVISIONS. (a) Upon the placement of recyclable materials at a designated recycling collection location for collection by an authorized recycling contractor, the recyclable materials shall become the property of the authorized recycling contractor. (b) It shall be unlawful for any person other than the authorized City employee or the City's authorized recycling contractor to take, remove or otherwise appropriate recyclable materials which have been placed for recycling collection or the container in which such recyclable materials have been placed. Any and each such removal in violation hereof shall constitute a separate and distinct violation enforceable as provided by this Code. (c) Nothing in this Article shall limit the right of an individual person, organization or other entity to donate, sell or otherwise dispose of recyclable material, provided that any such disposal is in accordance with the provisions of this Chapter. 5
