(d) Nothing in this Chapter shall be deemed to limit the right of an authorized <br /> recycling contractor to bring a civil action against any person who violates this <br /> Section 3 -6 -132. A conviction for a violation of Section 3 -6 -132 of this Chapter <br /> shall be an infraction or misdemeanor pursuant to Title VIII, Chapter 1 of the San <br /> Leandro Municipal Code. <br /> Section 3 -6 -160: EXEMPTIONS FROM RECYCLING SERVICES. Any person who is <br /> exempted from garbage collection service in accordance with Section 3 -6 -140, can, upon <br /> request, be exempted from curbside recycling and yard clippings collection. <br /> ARTICLE 2. WASTE DISPOSAL <br /> Section 3 -6 -200: SOLID WASTE. "Solid Waste" shall mean and include all putrescible <br /> and non - putrescible solid and semi -solid wastes, including garbage, trash, refuse, rubbish, ashes, <br /> industrial wastes, manure, vegetable or animal solid and semi solid wastes and other discarded <br /> solid and semi solid wastes as defined in California Public Resources Code Section 40191, as <br /> that Section may be amended from time to time. Solid waste does not include abandoned <br /> vehicles and parts thereof, Hazardous Waste or low -level radioactive waste, Medical Waste, <br /> Unacceptable Waste, or Source Separated recyclables. Solid waste includes the useless, unused, <br /> unwanted, or discarded material resulting from normal community activities, or materials which <br /> by their presence may injuriously affect the health, safety, and comfort of persons and depreciate <br /> property values in the vicinity thereof. <br /> Section 3 -6 -205: REFUSE. "Refuse" includes garbage as defined in Section 3- 6- 100(b) of <br /> the San Leandro Municipal Code, and rubbish as defined in Section 3 -6 -210 of the San Leandro <br /> Municipal Code. Refuse means all putrescible and non - putrescible solid wastes, except sewage, <br /> whether combustible or noncombustible. <br /> Section 3 -6 -210: RUBBISH. "Rubbish" means all non- putrescible solid wastes. <br /> Section 3 -6 -215: INDUSTRIAL WASTE. "Industrial waste" means all liquid or solid <br /> waste substances, except sewage, from any producing, manufacturing, or processing business <br /> operation. <br /> Section 3 -6 -220: COMMERCIAL GARBAGE. "Commercial garbage" means garbage <br /> generated by stores, offices, and other non - profit or for - profit commercial or institutional <br /> sources, excluding residences. <br /> Section 3 -6 -221: COMMERCIAL RUBBISH. "Commercial rubbish" means rubbish <br /> generated by stores, offices, and other non - profit or for -profit commercial or institutional <br /> sources, excluding residences. <br /> Section 3 -6 -222: ORGANIC RECYCLABLE MATERIAL. Organic Recyclable Material <br /> means organic materials, including garbage, separately collected or saved for purposes of animal <br /> feed, and/or producing compost, mulch, soil amendment, fertilizer, or other material which can <br /> be returned to the economic mainstream. <br /> 6 <br />
