• <br /> any amount remaining in the Maintenance District fund may be transferred to the City's <br /> General Fund, may be expended for Maintenance District purposes until exhausted, or <br /> may be refunded to the owners prorata to each assessment, as the City Council in its sole <br /> discretion may determine. <br /> Section 2 -5 -465. PERFORMANCE OF MAINTENANCE. <br /> The Maintenance of the Improvements may be performed by City forces to <br /> the extent allowed by the City's Charter and Municipal Code and/or by one or more <br /> contractors retained by the City. The letting of contracts for Maintenance shall be <br /> accomplished in accordance with general procedures and requirements for public works <br /> contracts of the City. The account of the Maintenance District shall be charged for all <br /> direct costs, supervision and administration costs in accordance with normal and <br /> reasonable costs accounting standards and procedures, whether performed by the City <br /> and/or by a contractor. • <br /> Section 2 -5 -470. CONSOLIDATION OF PROCEDURES. <br /> Procedures for the formation of a Maintenance District pursuant to this <br /> Chapter may be consolidated with procedures for the construction or acquisition of the <br /> Improvements pursuant to any other provision of this Code or pursuant to any law of the <br /> State of California, including without limitation the Improvement Act of 1911, the <br /> Municipal Improvement Act of 1913, or the Landscaping and Lighting Act of 1972, or <br /> any other procedure of a similar nature under the general statutes of the State of <br /> California. <br /> Section 3. SEVERABILITY. <br /> If any subsection, sentence, clause, phrase, or word of this Ordinance is for any <br /> reason declared unconstitutional, invalid or ineffective by any court of competent <br /> jurisdiction, such decision shall not affect the validity or the effectiveness of the <br /> remaining portions of this Ordinance or any part thereof. The Council hereby declares <br /> that it would have adopted this Ordinance notwithstanding the unconstitutionality, <br /> invalidity, or ineffectiveness of any one or more of its subsections, sentences, clauses, <br /> phrases, or words. <br /> Section 4. PUBLICATION. <br /> The title of this ordinance shall be published once and the City Clerk shall <br /> post a complete copy thereof on the City Council Chamber bulletin board for five (5) <br /> days following its adoption. <br /> 1I <br />
