4. The drainage Swale in the proposed landscape buffer along the northern property boundary <br /> shall be designed to the satisfaction of the City Engineer, such that no ponding or backup of <br /> runoff occurs in the upslope properties draining to this swale. <br /> 5. All storm drains that are to be maintained by the City shall be located within easements on <br /> private streets. The easements shall extend along the entire length of the public storm drain <br /> system and shall be a minimum of twenty feet (20') centered along the pipe. <br /> 6. The proposed storm drain system. from Peralta Avenue to the existing 36" public storm <br /> drain, shall be owned and maintained by the Subdivider and/or the project Homeowners' <br /> Association. <br /> 7. The subdivision shall be graded to allow for the overland release of runoff into San Leandro <br /> Creek during a higher than design storm event and/or in the event of total failure of the on- <br /> site storm drainage system. <br /> D. GRADING AND EROSION CONTROL <br /> 1. Prior to the approval of the first Final Map, the Subdivider shall submit all information <br /> including a Grading Plan accompanied by Soils Engineering and Engineering Geology <br /> Reports, in the accordance with requirements of the City of San Leandro Municipal Code <br /> Title VII, Chapter 12 and obtain a grading permit. <br /> 2. To control both during and post construction storm water pollution, the Subdivider shall <br /> comply with the regulations and provisions contained in the City's Grading Ordinance, <br /> the City's Storm Water Pollution Prevention Permit, and the National Pollutant Discharge <br /> Elimination System (NPDES), to the satisfaction of the City Engineer and the Regional <br /> Water Quality Control Board. <br /> 3. Until such time as all construction for the development has been completed to the <br /> satisfaction of the City Engineer. the Subdivider shall provide current Erosion & <br /> Sediment Control Plans, and amended Storm Water Pollution Prevention Plans <br /> (SWPPPs) for all portions of the site where construction is ongoing. Said Plans shall be , <br /> submitted to the City Engineer for review and approval on or before September 1 of each <br /> calendar year. and shall be fully implemented on or before October 15 of each calendar <br /> year. <br /> 4. The Urban Runoff Clean Water Program requires that all runoff be treated to remove <br /> sediment and water borne pollutants prior to discharge into a public facility. If filtration <br /> type catch basins are used. the CC &R's shall specify the responsibility of the <br /> Homeowners' Association to regularly inspect and maintain the filtration systems.
