IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2000- 65 (2811) <br /> RESOLUTION MAKING FINDINGS REGARDING UNEXPENDED <br /> DEVELOPMENT FEES COLLECTED AS A CONDITION OF APPROVAL OF THE <br /> HERON BAY (ROBERTS' LANDING) DEVELOPMENT <br /> Recitals <br /> A. In May 1995, in accordance with the provisions of the Mitigation Fee Act, <br /> Government Code Section 6600 et seq., and as a condition of approving the Heron Bay (Roberts' <br /> Landing) development project (also referred to as the Citation Homes development), the City <br /> collected from Citation 1 -Tomes a fee for the construction of public improvements. During the <br /> 1997 -1998 fiscal year, the funds collected were appropriated to the Capital Improvement <br /> Program for improvements at the intersection of Lewelling and Hesperian Boulevards. At <br /> present, the City has not yet expended the funds. <br /> B. Government Code Section 66001(d) requires cities, in the fifth fiscal year <br /> following the collection of such fees, to make specified findings regarding the unexpended funds <br /> in connection with Government Code Section 66006(b) requiring cities to provide information <br /> annually to the public about those funds. <br /> C. On April 25, 2000, the City made available to the public the information <br /> regarding the fee collected and provided notice of this hearing, pursuant to Government Code <br /> Section 66006(b). <br /> D. The City Council has considered the information that was made available to the <br /> public regarding the fee collected from Citation Homes, as required by Government Code <br /> Section 66006(b). <br />
