N THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> • RESOLUTION NO. 2000— 125 (1055/1170) <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> CALLING A SPECIAL MUNICIPAL ELECTION FOR SUBMISSION OF A <br /> QUESTION TO THE QUALIFIED VOTERS RELATING TO THE REPEAL OF SAN <br /> LEANDRO'S REAL PROPERTY TRANSFER TAX; CONSOLIDATING THE <br /> SPECIAL MUNICIPAL ELECTION WITH THE GENERAL MUNICIPAL ELECTION <br /> TO BE HELD TUESDAY, NOVEMBER 7, 2000; APPROVING THE FORM OF THE <br /> BALLOT QUESTION; SETTING FORTH PROCEDURES FOR BALLOT <br /> ARGUMENTS AND REBUTTALS AND DIRECTING THE CITY CLERK TO <br /> SUBMIT THE MEASURE TO THE CITY ATTORNEY FOR IMPARTIAL <br /> ANALYSIS <br /> WHEREAS, under the provision of the Charter, a General Municipal Election <br /> shall be held on November 7, 2000, for the election of Municipal Officers; and <br /> WHEREAS, the City Council has received certified petitions requesting that a <br /> measure be submitted to the voters relating to a repeal of the City of San Leandro's Real <br /> Property Transfer Tax; <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN <br /> LEANDRO, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND <br /> ORDER AS FOLLOWS: <br /> SECTION 1. The City Council hereby calls a Special Municipal Election of the <br /> qualified voters of the City of San Leandro, to be held on November 7, 2000, to submit to <br /> the voters an amendment to the City's Municipal Code regarding the repeal of the Real <br /> Property Transfer Tax (attached as Exhibit "A "). <br /> SECTION 2. The ballot measure shall appear and be printed upon the ballots to <br /> be used at the Election as follows: <br /> Shall an ordinance be adopted to repeal the existing City of San Leandro YES _ <br /> real property transfer tax, which is a tax required to be paid at the time <br /> real property in the City of San Leandro is sold or transferred, with some NO _ <br /> exceptions, and to prohibit imposition of a new real property transfer tax? <br /> SECTION 3. Pursuant to the provisions of the Elections Code of the State of <br /> California, the City Council of the City of San Leandro hereby requests that the Special <br /> Municipal Election of the City of San Leandro to consider this measure be held <br /> November 7, 2000, in conjunction with and to be consolidated with the General <br />
