term of this Agreement, in excess of the initial Fifty thousand dollars <br /> (550,000) may be passed through to Tenants as additional rent on a pro- <br /> rated basis, provided these costs are amortized over a five (5) year period, <br /> separately stated on the rent bills, will not be subject to annual percentage <br /> increases, and are eliminated once complete reimbursement has been <br /> achieved. Tenants' pro -rata share shall be calculated on the basis of the <br /> actual number of mobilehome spaces in the Park. These costs will be net <br /> of any insurance reimbursement. Landlord shall maintain, throughout the <br /> term of this Agreement, the types and amounts of property insurance in <br /> effect on December I, 2000, provided said insurance continues to be <br /> commercially available and at costs which are no greater than the <br /> premiums in effect on December 1, 2000, adjusted each year by the <br /> percentage amount of the annual rent increase as provided in Section D. If <br /> said property insurance is not commercially available and/or the costs <br /> exceed the amounts indicated above, Landlord reserves the right at its sole <br /> discretion to make any adjustments or modifications it deems reasonable <br /> and prudent to the amounts and types of property insurance on the Park. If <br /> the amounts and types of property insurance are significantly reduced or <br /> eliminated, Landlord will so notify a committee of Tenant representatives. <br /> Costs to repair the damage per event or occurrence may be generated from <br /> more than one contractor, and will be added together to arrive at the total <br /> amount of costs to be passed through to each Tenant as provided above. <br /> F. 1 Jtilities; <br /> Landlord retains the right to submeter water or to separately charge for any utility service <br /> in accordance with State law. <br /> G. Rent Increases on Resale; <br /> In the case of an on -site resale of Tenant's mobilehome on or after December 1, <br /> 2000, Landlord may increase the rent fifteen percent (15 %) of the rent paid by the <br /> selling tenant at the time of resale to a maximum of 575.00 per month. Landlord <br /> may increase the rent on resale only once per space during the entire term of this <br /> Agreement, except as provided in Subparagraph 2 below. <br /> 2. This limitation on the amount of the increase stated above shall not apply in the <br /> following cases: <br /> a. The owner of the mobilehome has voluntarily removed it or has caused it <br /> to be removed from the space and has terminated his or her tenancy in the <br /> Park. <br /> b. Landlord obtained an unlawful detainer judgment affecting the space in a <br /> court of competent jurisdiction. <br /> 5 <br /> 531 <br />
