Amendment to Section 2.5 of Administrative Code 2 September 20, 2010 <br /> would be raised by the applicant seeking relief based on the circumstances of the subject <br /> property. Thus, the ADA Coordinator would work with the applicant and staff to define and <br /> ultimately allow reasonable accommodations under the City's zoning code. In addition. approval <br /> of this recommendation would allow the City options for how to address reasonable <br /> accommodations in zoning and land use for the upcoming zoning code update. <br /> As the original Reasonable Accommodation policy stated, the Community Relations <br /> Representative is identified as the ADA Coordinator, and the Housing Specialist I is identified as <br /> the Section 504 Coordinator for purposes of managing the Reasonable Accommodation policy <br /> and procedures. To date no grievances have been filed with the City's ADA Coordinator.. Staff <br /> would like to be prepared should one be filed. <br /> Upon adoption of this amendment staff will file a letter of compliance with HCD, which staff <br /> believes, based on I -1CD staffs representations, will allow the City's Housing Element to be <br /> certified. <br /> Current City Council Policy <br /> The City's ADA Coordinator and Grievance Policy were created in November 2009 with the <br /> adoption of the Reasonable Accommodation policy approved as part of the amendment of Title <br /> 2, Chapter 5 of the Administrative Code. <br /> Previous City Council Action(s) <br /> In 2009, the City Council approved the City's Reasonable Accommodation policy within the <br /> Administrative Code. <br /> On September 9, 2010 the draft Reasonable Accommodation policy was reviewed by the <br /> Business and Housing Development Committee. <br /> Summan• of Public Outreach Efforts <br /> No public review is required at this time for the Administrative Code amendment which would <br /> bring the City's Reasonable Accommodation policy into conformance with state and federal <br /> housing law. It is anticipated that the City will incorporate some parts of this amendment into the <br /> City's zoning code in the coming months. With a zoning code amendment there will be noticed <br /> hearings before the Planning Commission and City Council. <br /> Fiscal Impact <br /> None. Staff assigned to these duties will absorb these functions as part of their normal <br /> assignments. <br /> Attachments <br /> None. <br /> Conclusion <br /> It is recommended that Title 2, Chapter 5 of the Administrative Code be amended to allow for <br /> revisions to the existing Reasonable Accommodation policy relative to zoning and land use <br /> restrictions. <br />
