AGREEMENT <br /> This Cooperative Agreement for Ownership, Operation and Maintenance of SMART <br /> Corridors ( "Agreement ") is entered into as of the last date set forth on the signature page hereto <br /> (the "Effective Date ") by and between the Alameda County Congestion Management Agency <br /> ( "CMA ") and the following participating Governmental Entities ( "Participating Agencies "): <br /> Contra Costa Transportation Authority(CCTA) City of Albany <br /> City of Berkeley <br /> City of El Cerrito <br /> Contra Costa County City of Emeryville <br /> Alameda County City of Hayward <br /> City of Hercules <br /> Metropolitan Transportation Commission (MTC) City of Oakland <br /> City of Pinole <br /> California Department of Transportation, District 4 City of Richmond <br /> City of San Leandro <br /> Alameda- Contra Costa Transit District City of San Pablo <br /> Western Contra Costa Transit Authority City of Union City <br /> CMA and Participating Agencies are sometimes referred to herein individually as a <br /> "Participating Agency," "Party," and collectively as the "Parties ". <br /> RECITALS: <br /> A. The Parties desire to respectively own and cooperatively operate and maintain <br /> certain street and highway improvements and ATMS equipment designated as the San Pablo <br /> Avenue SMART Corridor ( "San Pablo Project ") and the 1 -880 SMART Corridor ( "1 -880 <br /> Project ") pursuant to Streets and Highways Code Section 130; <br /> B. The improvements and equipment have been, or will be installed by the Parties <br /> enabling the effective management of traffic congestion and the improvement of throughput of <br /> people on San Pablo Avenue within the jurisdictions of the San Pablo Avenue SMART Corridor <br /> Cities commencing in the South at 17 Street in Downtown Oakland and terminating in the <br /> North at State Route 4 in the City of Hercules or as depicted in the San Pablo Project map <br /> attached as Exhibit A and incorporated by reference herein; <br /> Smart OM - Version 2 <br />
