IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2010 -136 <br /> RESOLUTION OF INTENTION CALLING FOR A PUBLIC HEARING TO ESTABLISH AN <br /> UNDERGROUND UTILITY DISTRICT ON EDEN ROAD FROM DOOLITTLE DRIVE TO <br /> DAVIS STREET, AND SETTING THE DATE FOR A PUBLIC HEARING ON JANUARY 3, <br /> 2011 <br /> Recitals <br /> The City Council of the City of San Leandro does RESOLVE as follows: <br /> Pursuant to the provisions of Section 5 -3 -200 of the San Leandro Municipal Code, the City <br /> Council hereby calls a public hearing to ascertain whether or not the public necessity, health or <br /> safety require the removal of poles and overhead wires and associated overhead structures, and the <br /> underground installation of wires and facilities for supplying electric, communication, television, <br /> or similar associated service, in the following areas: <br /> A. Eden Road, as shown on the plan line of the same name, adopted by Ordinance 2007- <br /> 002, generally described as the existing Eden Road from Doolittle Drive to the Water <br /> Pollution Control Plant and an extension of Business Center Drive from Davis Street to <br /> Eden Road. <br /> Said hearing shall be held on Monday, January 3, 2011, at the hour of 7:00 p.m., in the <br /> Council Chambers of the San Leandro City Council, in San Leandro City Hall, 835 East 14 <br /> Street, San Leandro, California. Any and all persons having any objections to the establishment of <br /> the underground district may appear before said Council and show cause why the establishment of <br /> said underground district should not be ordered. Objections to the establishment of the proposed <br /> underground district may be filed in writing with the City Clerk at any time not later than the hour <br /> set for said hearing by any person having any interest in any land upon which said undergrounding <br /> district is proposed to be established. <br /> Notice of Exemption is being reviewed and will be filed by the Community Development <br /> Department. <br /> The City Clerk shall cause the Public Hearing Notice to be published once a week for at <br /> least two successive weeks prior to the date of public hearing stated herein. The first publication <br /> shall be no later than December 20, 2010. Said Public Hearing Notice shall be posted <br /> conspicuously along the line of the street or easement proposed to be undergrounded at least two <br /> weeks before the date set for hearing. Such Public Hearing Notice shall be posted not more than <br /> three hundred (300) feet apart, but at least three (3) shall be posted. <br />
