IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2010 -136 RESOLUTION OF INTENTION CALLING FOR A PUBLIC HEARING TO ESTABLISH AN UNDERGROUND UTILITY DISTRICT ON EDEN ROAD FROM DOOLITTLE DRIVE TO DAVIS STREET, AND SETTING THE DATE FOR A PUBLIC HEARING ON JANUARY 3, 2011 Recitals The City Council of the City of San Leandro does RESOLVE as follows: Pursuant to the provisions of Section 5 -3 -200 of the San Leandro Municipal Code, the City Council hereby calls a public hearing to ascertain whether or not the public necessity, health or safety require the removal of poles and overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, television, or similar associated service, in the following areas: A. Eden Road, as shown on the plan line of the same name, adopted by Ordinance 2007- 002, generally described as the existing Eden Road from Doolittle Drive to the Water Pollution Control Plant and an extension of Business Center Drive from Davis Street to Eden Road. Said hearing shall be held on Monday, January 3, 2011, at the hour of 7:00 p.m., in the Council Chambers of the San Leandro City Council, in San Leandro City Hall, 835 East 14 Street, San Leandro, California. Any and all persons having any objections to the establishment of the underground district may appear before said Council and show cause why the establishment of said underground district should not be ordered. Objections to the establishment of the proposed underground district may be filed in writing with the City Clerk at any time not later than the hour set for said hearing by any person having any interest in any land upon which said undergrounding district is proposed to be established. Notice of Exemption is being reviewed and will be filed by the Community Development Department. The City Clerk shall cause the Public Hearing Notice to be published once a week for at least two successive weeks prior to the date of public hearing stated herein. The first publication shall be no later than December 20, 2010. Said Public Hearing Notice shall be posted conspicuously along the line of the street or easement proposed to be undergrounded at least two weeks before the date set for hearing. Such Public Hearing Notice shall be posted not more than three hundred (300) feet apart, but at least three (3) shall be posted.
