When an employee has been injured in the line of duty and receives compensation in <br /> accordance with the provisions of any Workers' Compensation Act of the State of California, <br /> the . ' • ` ACM /desicnee shall have submitted to him/her reports on the <br /> forms in the manner prescribed. <br /> An employee injured in the line of duty who requires medical care and /or physical therapy shall <br /> schedule, as far as practicable, such appointments at a time so as to be as least disruptive to the <br /> work schedule. <br /> Modified Duty - It is the policy of the City to encourage employees to return to work as soon as <br /> possible. Every effort will be made to accommodate to an employee's medical needs to ensure <br /> a speedy return to work. An injured employee is required to cooperate and comply with request <br /> for information to facilitate the employees' return to work, either on a modified basis or a return <br /> to full duties. <br /> Industrial Disability Management Program - The parties agree to cooperate in the development <br /> of an industrial disability management program. <br /> Section 17. flours of Work <br /> A work week shall be computed as the number of hours customarily considered as a full week's <br /> work in the classification and in the department in which the person is employed. <br /> Public Works employees who are regularly assigned to work a majority of their regularly <br /> scheduled shift between the hours of 4:00 p.m. and 12:00 a.m. (swing) shall receive a shift <br /> differential of one hundred seventy -five dollars ($175.00) per month. Public Works employees <br /> who are regularly assigned to work a majority of their regularly scheduled shift between the <br /> hours of 12:00 a.m. and 8:00 a.m. (graveyard) shall receive a shift differential of two hundred <br /> ($200.00) per month. Employees who are regularly assigned to provide relief assignments for <br /> swing and /or graveyard shift(s) shall receive a shift differential for the time spent working on <br /> such shift(s). <br /> It is understood that such shift differential shall be included in the computations based upon the <br /> base rate for purposes of overtime compensation, holiday, sick leave and vacation leave pay <br /> • where the employee has worked a shift which requires payment of the differential, as provided <br /> in the preceding paragraph, for thirty (30) days or more. <br /> The setting of work hours is based upon the operational needs of the department. An <br /> employee's work hours may be changed based upon the operational needs of the department. In <br /> the event an employee's work schedule is to be changed; the employee shall be given seven (7) <br /> working days advance notice. <br /> Section 18. Outside Work <br /> An employee's primary employment responsibility is to the job the employee has with the City. <br /> Any employee who wishes to engage in employment outside a City position shall first submit a <br /> written request to his /her department head and receive approval for same before engaging in <br /> any such employment. Such outside employment shall not adversely affect job performance or <br /> create a conflict of interest with the employee's City position.
