IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2010 -156 <br /> RESOLUTION ADDING TITLE 8, CHAPTER 11 TO THE SAN LEANDRO <br /> ADMINISTRATIVE CODE RELATED TO FINANCING OF SEWER LATERAL <br /> CONNECTIONS TO CITY SEWERAGE SYSTEM FOR PRIVATE SEWER LATERAL <br /> RELOCATIONS NECESSITATED BY SEWER MAIN ABANDONMENTS <br /> WHEREAS, pursuant to San Leandro Municipal Code ( "SLMC ") section 3 -14 -640, it is the <br /> responsibility of a property owner or User, as User term is defined in SLMC section 3- 14- 200(bm), <br /> to operate, maintain. and repair a private sewer lateral; and <br /> WHEREAS, from time to time it is necessary for the City to abandon, update, and replace <br /> Publicly Owned Treatment Works (POTW), to protect the public health, safety and welfare, which <br /> in some situations, will trigger the need for a property owner or User to re- connect a building or <br /> structure on the property to updated or replaced POTW facilities; and <br /> WHEREAS, the City Council finds that it is in the public's interest to minimize the impact <br /> to property owners and Users of re- connecting private sewer laterals to updated or replaced POTW <br /> facilities; and <br /> WHEREAS, to further this legitimate public interest the City Council desires to amend the <br /> administrative code to provide a means by which property owners and Users may work <br /> cooperatively and collaboratively with the City to minimize the practical and financial impacts of <br /> POTW abandonments and subsequent re- connections of private sewer laterals to POTW facility <br /> updates or replacements. <br /> The Council is familiar with the contents of the proposed administrative code amendments. <br /> The City Manager recommends approval of said administrative code amendments. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> That Title 8, Chapter 1 l of the San Leandro Administrative Code, a copy of which is <br /> attached, is hereby approved, and the City Manager is hereby authorized to execute all documents <br /> to effect the advancement of the policies and purposes stated therein. <br /> Introduced by Councilmember Prola and passed and adopted this 20th day of December, <br /> 2010, by the following called vote: <br />
