CITY OF SAN LEANI)RO <br /> CITY COUNCIL RULES AND COMMUNICATIONS COMMITTEE <br /> February 24, 2011 <br /> 4:30 - 5:30 p.m. <br /> San Leandro City Hall <br /> 835 East l4th Street <br /> San Leandro, California <br /> Meeting venue changed from the Sister Cities Gallery <br /> to the City Manager's Large Conference Room <br /> HIGHLIGHTS <br /> Committee Members <br /> present: Mayor Stephen Cassidy, Vice Mayor Ursula Reed, and Councilmember Jim <br /> Prola <br /> City Staff present: Rayan Fowler, Information Services Manager; Marian Handa, City Clerk; Steve <br /> Hollister, City Manager; Lianne Marshall, Assistant City Manager; Kathy <br /> Omelas, Community Relations Representative; Richard Pio Roda, Assistant <br /> City Attorney <br /> Public present: None <br /> The meeting was called to order at 4:40 p.m. by Mayor Cassidy. <br /> 1. Review of Amendment to the Code Enforcement Hearing Process, to Change the Hearing Body <br /> from Board of Zoning Adjustments to an Administrative Hearing Body <br /> Assistant City Attorney Rich Pio Roda noted that this matter had been vetted previously by the <br /> Committee- He commented on the reasons for the proposed change: the BZA's once - per -month <br /> meeting schedule causes delays in the hearing process; additional staff time and overtime is involved in <br /> preparing and presenting matters for a BZA hearing; and code enforcement issues are outside the <br /> BZA's expertise. Appeals of decisions by the Zoning Enforcement Official would still go to the BZA, <br /> while code enforcement, community preservation, and other Municipal Code violations would be <br /> handled by an administrative hearing body, composed of members of the City's management staff. <br /> Decisions of the hearing body would be appealable to the City Manager, whose decisions would be <br /> final. <br /> Mr. Pio Roda indicated that he would also perform some clean up of the current appeals legislation. He <br /> anticipates that the ordinance to change the hearing body for Code Enforcement matters would be <br /> presented to the City Council on March 21 <br /> Committee Member Reed recalled the discussion.regarding combining the Planning Commission and <br /> BZA. City Manager Steve Hollister commented that the discussion arose out of a concern about staff <br />
