WHEREAS, the San Leandro Planning Commission, having conducted a public hearing, <br /> and having reviewed the Negative Declaration of environmental impact prepared in connection <br /> with the proposed amendments to Zoning Code Article 3, Section 1 -304; Article 6, Sections 2- <br /> 636, 2 -640, 2 -642, 2 -644; Article 7, Section 2 -704; Article 10, Section 3 -1022; and Article 17, <br /> Section 4 -1702; at its meeting of February 17, 2011, has recommended to the City Council that <br /> said amendments to Zoning Code Article 3, Section 1 -304; Article 6, Sections 2 -636, 2 -640, 2- <br /> 642, 2 -644; Article 7, Section 2 -704; Article 10, Section 3 -1022; and Article 17, Section 4 -1702; <br /> be approved; and <br /> WHEREAS, the City Council has conducted a public hearing and reviewed and <br /> considered the Negative Declaration, and has determined that it has been completed by the <br /> Department of Community Development of the City of San Leandro in compliance with the <br /> requirements of the California Environmental Quality Act; and <br /> WHEREAS, the office of the Department of Community Development of the City of San <br /> Leandro is located at 835 E. 14 Street, San Leandro, California, and said Department is the <br /> custodian of the documents or other materials forming the basis for this determination. <br /> NOW, THEREFORE, the City Council of the City of San Leandro approves the attached <br /> Negative Declaration, and finds and resolves as follows: <br /> 1. The Negative Declaration reflects the City's independent judgment and analysis on <br /> the potential environmental effects of the proposed amendments to Zoning Code Article 3, <br /> Section 1 -304; Article 6, Sections 2 -636, 2 -640, 2 -642, 2 -644; Article 7, Section 2 -704; Article <br /> 10, Section 3 -1022; and Article 17, Section 4 -1702; and was presented to the City Council prior <br /> to their consideration of said amendments. <br /> 2. On the basis of the whole record before the Council, including the initial study, there <br /> is no substantial evidence that the proposed amendments to Zoning Code Article 3, Section 1- <br /> 304; Article 6, Sections 2 -636, 2 -640, 2 -642, 2 -644; Article 7, Section 2 -704; Article 10, Section <br /> 3 -1022; and Article 17, Section 4 -1702; will have a significant effect on the environment. <br /> Introduced by Councilmember Prola on this 21st day of March, 2011, and passed and <br /> adopted by the following called vote: <br /> Members of the Council: <br /> AYES: Councilmembers Cutter, Gregory, Prola, Reed, Souza, Starosciak; <br /> Mayor Cassidy (7) <br /> NOES: None (0) <br /> ABSENT: None (0) <br /> ATTEST: 4' a/R12C <br /> Marian Handa, City Clerk <br /> RESOLUTION NO. 2011-060 2 <br />
