COUNCILMEMBERS HANDBOOK APPENDIX H
content that it deems, in its sole discretion, to be unwarranted. abusive, in violation of
copyright and/or trademark law, or other intellectual property of any third party, or is in
violation of this policy or any other applicable law, or poses a threat to the City
technology system or its security.
• Social Media sites are subject to the State of California public records laws. Content
posted on a City Social Media site is a public record. Many Social Media sites provide
the ability to email daily /weekly digests to the administrator. If at all possible, these •
digests are to be setup and the email should be saved to comply with the public records
laws. Content on Social Media Sites where data collection is not possible retention will
be maintained consistent with that Social Media site's particular terms of service. For
example, if Social Media Site allows the end user access to the last six months of content
and comments, the retention of that data is six months.
• Consideration should be given to the fact that most social networking websites permit
and invite responsive posts by readers. Allowing interactive, responsive posting can be
of great benefit to the City in that it offers a channel for persons to provide feedback and
suggestions. Unfortunately, it is resource intensive and provides an opportunity for
• harmful communications to occur.
•
Postine and Maintenance of the Social Media Site
• If a Social Media site allows comments, the following disclaimer should be visible on the
site: "Comments posted to this page will be monitored. Under the City of San Leandro
Social Networking Policy, the Council Member reserves the right to remove
inappropriate comments including those that have obscene language or sexual content;
content that promotes, fosters, or perpetuates discrimination on the basis of race, religion,
color, national origin, gender, sexual orientation, marital status, age or physical or mental
disability, or any other protected status; threaten or defame any person or organization;
violate the legal ownership interest of another party; support or oppose political candidate
or ballot propositions; promote illegal activity; endorse commercial services or products;
or are not topically related to the particular posting. Any threatening or promoting of
illegal activity will be referred to the San Leandro Police Department"
• Any inappropriate content and comments described above shall not be allowed and must
be immediately removed.
• Any Social Media website that a Council Member wishes to maintain must have the
ability to remove posts that are unacceptable.
• The website should be reviewed regularly to insure the compliance with the response
policy.
• All information posted, or pages created must comply with all applicable federal. state
and City laws, regulations and policies; not include photographs or images of anyone
who can be identified, without first obtaining a signed release of any such person, or
•
