IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2011 - <br /> RESOLUTION APPROVING A REPAIR AND MAINTENANCE AGREEMENT WITH THE <br /> PORT OF OAKLAND RELATED TO THE BAY TRAIL SLOUGH BRIDGE PROJECT, <br /> PROJECT NO. 08- 144 -39 -012, FEDERAL AID PROJECT NO. HP21 L- 5041(025), <br /> CONSTRUCTED ON PORT PROPERTY <br /> Recitals <br /> WHEREAS, on October 1, 2008, the Port of Oakland (Port) and the City entered into a <br /> Right of Entry and Indemnity Agreement allowing the City to construct a portion of the Bay <br /> Trail Slough Bridge project on Port property and that upon completion of the project, the Port <br /> shall take ownership of the improvements located on Port property; and <br /> WHEREAS, on July 25, 2010, the Port determined the Trail Improvements on Port <br /> property to be completed and the Port is now responsible for operation and maintenance of that <br /> portion of the improvements; and <br /> WHEREAS, an agreement has been presented to this Council; and <br /> WHEREAS, the City Manager has reviewed the agreement attached hereto and <br /> recommends approval, <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> fol lows: <br /> 1. That the Repair and Maintenance Agreement between the Port of Oakland and the <br /> City of San Leandro is hereby approved; and <br /> 2.
